방대한 양의 데이터 패턴과 구조를 학습해 새로운 데이터를 창조하는 생성형 AI는 범용성과 지능증강성을 기반으로 우리사회 전반에 깊숙하게 스며들어 변화와 혁신을 유발하고 있다. 하지만 역설적으로 생성형 AI가 데이터를 수집하는 과정에서 발생하는 개인정보 유출문제, 학습과정에서 발생하는 재식별 문제, 그리고 데이터를 재생산하는 과정에서 발생하는 형사법적 문제는 현행 개인정보보호법제로는 효과적 대응이 어렵다. 이 연구에서는 생성형 AI 발전으로 인해 발생할 수 있는 개인정보 침해 위험에 대한 법적 쟁점을 생성형 AI의 작동 메커니즘에 입각(①데이터 수집, ②데이터 학습, ③데이터 활용, ④생성된 결과물, ⑤작동방식 전반)하여 진단하고 현행 개인정보보호법의 개정 방향을 제시하였다.

Through the generation of new data, our society is experiencing change and innovation, but at the same time, The social problems of collecting, learning, and reproducing data in a reckless and biased manner continue to arise. However, Personal Information Protection Act does not fully cover cases of personal information infringement that occur during the complex data processing process of Generative AI. This study diagnosed legal issues related to the risk of personal information infringement. And based on this, the direction of revision of the Personal Information Protection Act consistent with the future generative AI technology was suggested.
