제조물책임법상 결함과 면책사유에 관한 소고

A Study on the Defect and Exemption Clauses on Product Liability Act

본 연구는 과학기술의 혁신적 발전에 따른 국가산업발전을 위하여 결함의 판단기준과 면책사유를 확대하는 것보다는 제조물책임법의 입법취지에 부합되도록 다양한 판례의 분석과 해석론적 검토를 통해 향후 제도의 합리적 운용을 위한 해석의 기준과 입법방안을 위한 하나의 기준점이 될 수 있을 것으로 기대한다. 최첨단의 과학기술을 바탕으로 자율주행자동차, 선박, 산업용 인공지능 로봇 등이 개발되면서 인간에게 편리성과 효율성을 제공하지만, 그로 인하여 사고가 발생할 경우 기존 결함에 관한 해석기준과 과학기술의 혁신과 국가산업발전을 위한 개발위험이나 법령준수의 항변 등의 면책사유를 주장할 수 있는가가 문제된다. 우리 법원은 소비자 보호라는 제조물책임법의 입법 취지를 우선시하여 개발위험의 항변을 극히 제한적으로 인정하고 있으며, 법령 준수만으로는 면책을 허용하지 않는 경향을 보이고 있다. 그러나 현행 규정은 결함의 판단기준이 불명확하고, 면책사유의 기준이 추상적으로 규정되어 있어서 예측가능성을 저해하고 있다. 따라서 결함판단기준을 실무상 구체화하여 운용할 수 있는 해석의 기준과 면책사유의 요건인 개발위험의 항변과 법령준수의 항변과의 관계를 정립시키는 방안을 제시하면서 나아가 제조물의 안전성 확보 및 지시경고의무 이행 여부를 면책 판단의 주요요소로 하는 방향으로 입법론적·해석론적 개선이 필요함을 제언한다.

This study aims to serve as a reference point for interpretative standards and legislative measures for the rational operation of the product liability system in the future, by analyzing and doctrinally reviewing various judicial precedents in a manner consistent with the legislative purpose of the Product Liability Act, rather than by expanding the criteria for defect determination or the grounds for exemption from liability in the name of national industrial development driven by innovative advances in science and technology. Based on cutting-edge science and technology, autonomous vehicles, ships, and industrial artificial intelligence robots have been developed to provide convenience and efficiency to humans. However, if an accident occurs as a result, it is a question of whether it is possible to claim reasons for indemnification, such as the criteria for interpretation of existing defects, innovation of science and technology, development risks for national industrial development, or defense of compliance with laws and regulations. Korean courts prioritize the legislative purpose of consumer protection underlying the Product Liability Act, recognize the development risk defense only in extremely limited circumstances, and tend not to grant immunity from liability solely on the basis of compliance with statutory requirements. However, the current legal framework undermines legal predictability, as the standards for defect determination remain unclear and the criteria governing exemptions from liability are defined in abstract terms. Therefore, this study proposes a framework for clarifying the relationship between the development risk defense and the defense of compliance with statutory requirements, as grounds for exemption from liability, as well as interpretative standards that can be objectified and practically applied in legal practice. Furthermore, legislative and interpretative improvements are suggested in the direction of strengthening product safety and ensuring the proper fulfillment of the duty to provide instructions and warnings.
