1인 미디어 환경에서의 생성형 AI 기반 저작권 침해 쟁점과 대응 방안 연구

A Study on Copyright Infringement Issues and Response Measures in the One-Person Media Environment Based on Generative AI

본 연구는 1인 미디어 환경에서 생성형 인공지능(Generative AI)의 확산으로 인해 발생하는 저작권 침해 쟁점을 중심으로, 그 유형을 체계적으로 분석하고 대응 방안을 제시하는 데 목적이 있다. 유튜브, 인스타그램 등 다양한 플랫폼을 기반으로 활동하는 1인 창작자들은 이미지, 영상, 음악, 텍스트 등 시각·청각적 콘텐츠를 활용하면서 기존 저작권 체계와 충돌하는 사례를 빈번히 경험하고 있다. 특히 생성형 AI 기술은 기존 저작물의 무단 학습, 유사 표현의 자동 생성, 창작 주체의 불분명성 등 새로운 형태의 저작권 분쟁을 유발하고 있다. 이에 본 연구는 이미지 기반 콘텐츠를 중심으로 저작권 침해 사례를 유형화하고, 플랫폼별 대응 조치와 법적·정책적 한계를 비교·분석하였다. 아울러 국내외 관련 법제와 정책 동향을 검토하고, AI 기반 창작 환경에 적합한 저작권 제도 개선 방향, 플랫폼의 책임 강화, 이용자 인식 제고 및 교육 방안을 제안하였다. 이를 통해 생성형 AI 시대의 1인 미디어 창작 생태계에서 창작자와 이용자 간 권리 균형 및 공정한 이용 환경을 조성하기 위한 정책적 기초자료를 제공하는 데 그 의의를 둔다.

This study examines copyright infringement issues emerging in the one-person media environment due to the rapid spread of Generative Artificial Intelligence (AI). Individual creators on platforms such as YouTube and Instagram increasingly face conflicts with existing copyright systems while using images, videos, music, and text. Generative AI intensifies these challenges by enabling unauthorized learning of copyrighted works, generating similar expressions, and creating ambiguity over authorship. Focusing on image-based content, the study categorizes infringement cases, analyzes platform-specific responses, and identifies legal and policy limitations. It further reviews domestic and international legislative trends to suggest improvements to copyright systems, strengthening of platform accountability, and enhancement of user awareness and education. The findings aim to provide a foundation for balancing rights between creators and users and for fostering a fair, sustainable creative ecosystem in the era of generative AI..
