기본사회 실현을 위한 지방자치단체 조례의 입법설계에 관한 소고

An Exploratory Study on the Legislative Framework of Local Government Ordinances for the Basic Society

본고는 기본사회 논의를 지방자치단체 조례로 제도화하기 위해 필요한 법적·제도적 구조를 검토하고, 이를 토대로 지방정부 차원의 기본사회 조례 설계 방향을 제시하고자 한다. 기본사회는 주거·돌봄·보건·교통 등 주민의 삶을 구성하는 다양한 생활조건을 개별 정책이 아니라 상호 연계된 구조로 파악하는 접근으로, 급여 중심 복지체계만으로는 대응하기 어려운 생활정책의 복합성과 지역적 특수성을 전제로 한다. 본고는 기본사회 개념의 공법적 성격을 헌법상 인간다운 생활 보장과 사회국가원리에 따른 생활조건 형성의무를 중심으로 검토하고, 이러한 의무가 지방자치제도의 틀 안에서 조례를 통해 구체화될 수 있음을 논증하였다. 또한 국내 기본사회·기본소득 관련 조례 115건의 분석과 웨일즈·핀란드·뉴질랜드 사례에 대한 비교법적 검토를 통해, 생활정책이 장기계획, 지표기반 평가, 다층적 거버넌스, 민관협력 등 절차적·구조적 요소에 기초하여 형성·운영될 필요가 있음을 확인하였다. 이러한 분석을 바탕으로 본 연구는 광역과 기초의 기능적 역할을 구분한 기본사회 조례 설계 방향을 제안한다. 광역 수준에서는 비전·지표·조정구조 등 전략적 요소를 중심으로 규율하고, 기초 수준에서는 주민참여와 집행절차 등 생활권 단위의 실행 요소를 중심으로 구성하는 방식이 기본사회 조례 설계의 가능성임을 제시하였다. 특히 지급대상과 같이 정치적·법적 민감성이 높은 영역은 조례에서 직접 규정하기보다 시행계획이나 하위지침에 위임함으로써, 법률유보 원칙을 침해하지 않으면서 정책의 지속가능성과 지역별 유연성을 확보할 수 있음을 논증하였다. 본고의 의의는 기본사회 조례를 새로운 권리나 급부를 창설하는 규범이 아니라 생활정책의 연계·조정·평가 구조를 정렬하는 절차·조정형 조례로 위치지우고, 기본사회 논의를 지방자치단체의 자치입법을 통해 구현 가능한 정책 조정 규범의 문제로 재정식화하였다는 데에 있다.

This paper examines the legal and institutional framework for institutionalizing a basic society through local government ordinances. A basic society conceives residents’ living conditions—such as housing, care, health, and transportation—as interconnected structures beyond benefit-centered welfare systems. The study analyzes the public law nature of the basic society concept in relation to the constitutional guarantee of a decent standard of living and the social state principle, emphasizing that obligations to shape living conditions can be concretized through local ordinances. It further reviews 115 domestic ordinances related to basic society and basic income, together with a comparative legal analysis of Wales, Finland, and New Zealand, confirming the need for living policies to be formulated and implemented based on structural elements such as long-term planning, indicator-based evaluation, and multi-level governance. Based on these findings, the paper proposes a design framework for basic society ordinances that distinguishes the functional roles of metropolitan and local governments, and suggests enhancing policy sustainability and regional flexibility by delegating politically and legally sensitive matters, such as eligibility criteria, to implementation plans or subordinate guidelines rather than stipulating them directly in ordinances.
