｢학교폭력 가해학생 조치별 적용 세부 기준｣ 및 가해학생 조치 간 관계 분석

An Analysis of Relationship between the Measures on Aggressor School Violence and Judgment Factors

본 연구는 ｢학교폭력예방 및 대책에 관한 법률｣시행령 제19조에 근거한 ｢학교폭력 가해학생 조치별 적용 세부기준｣을 토대로 기본･부가적 판단 요소가 가해학생 조치 결정에 미치는 영향을 실증적으로 규명하고, 세부기준의 한계와 개선 방향을 도출하는 데 목적이 있다. 이를 위해 전국 학교폭력대책심의위원회의 심의 사례 685건을 대상으로 교차분석 및 회귀분석을 실시하여, 기본 판단 요소가 판정점수 총점에 미치는 영향과 부가적 판단 요소가 가중･경감 조치에 미치는 영향을 검증하였다. 분석 결과, 기본 판단 요소 판정 시 참고 요인 중 다수요인이 판정점수와 유의하게 관련되는 것으로 나타났다. 특히 판정점수 총점에 유의한 영향을 미친 요인은 성폭력 여부, 재산상 피해 여부, 피해학생 수, 위험한 물건 사용 여부, 지속 여부, 폭력의 사전 계획 여부, 주변의만류에도 폭력 행사 여부, 가해학생의 태도 변화 여부, 확인된 내용에 대한 인정 여부, 고소･고발 여부, 피･가해학생 간 화해 여부, 화해 노력 여부로 확인되었다. 한편 부가적 판단 요소 중 피해학생의 장애 여부가 가중 조치 가능성을 높이는 것으로 확인되었으나, 가해학생의 선도 가능성은 가중･경감 조치에 유의한 영향을 미치지않았다. 본 연구는 기존 논의가 상대적으로 부족했던 ‘요소별 영향력’ 검증을 사례 기반으로 수행하여, 향후 세부기준 운용 및 제도 보완 논의에 시사점을 제공한다.

Purpose: This study examines how core and supplementary decision factors affect disciplinaryoutcomes for perpetrators of school violence under the legally mandated detailed criteria. Italso identifies limitations of the current criteria and suggests directions for improvement.Design/methodology/data/approach: A total of 685 cases review ed by School ViolenceCountermeasure Deliberation Committees nationwide were analyzed. Cross-tabulation andregression analyses were conducted to assess the effects of core factors on total severity scoresand supplementary factors on aggravated or mitigated measures.Findings/Results: Multiple core decision factors were significantly associated with total severityscores. Key predictors included sexual violence, property damage, number of victims, use ofdangerous objects, persistence and premeditation of violence, continuation despiteintervention, perpetrator attitude change, acknowledgment of facts, criminal complaints,reconciliation, and reconciliation efforts. Among supplementary factors, victim disabilityincreased the likelihood of aggravated measures, whereas perpetrator rehabilitative potentialshowed no significant effect.Value: This study provides empirical, case-based evidence on factor-specific influences indisciplinary decision-making for school violence. The findings inform refinement ofdisciplinary criteria and support more consistent and transparent implementation.
