제도의 실효성과 중재자의 실천 사이: 사회복지시설 직장 내 괴롭힘 구제 경험과 개선방안

Between Institutional Effectiveness and Mediator Practice: Experiences of Remedies and Improvement Strategies for Workplace Bullying in Social Welfare Facilities

본 연구는 사회복지시설에서 직장 내 괴롭힘 사건을 중재한 구제담당자 2명과 구제전문가 3명의 경험을 통해 사회복지시설 직장 내 괴롭힘 사건 구제제도의 한계와 개선 과제를 탐색하기 위해 심층면접을 실시하고 주제분석을 적용하였다. 분석 결과, 절차의 형식화와 장기화로 인해 피해자와 중재자 모두 제도적 무력감과 소진을 경험했으며, 사건 초기 대응과 중립성 유지의 긴장은 중재자에게 큰 부담으로 작용하였다. 또한 기관장의 권력과 위계적 조직문화, 외부 세력의 개입은 사건 처리의 공정성을 훼손하였고, 법률·노무 비용 등 공공 지원 부재는 구제를 어렵게 만들었다. 예방 교육은 요식적 수준에 머물렀고, 피해자 사후 보호와 중재자 지원도 충분하지 않았다. 이에 본 연구는 절차 운영의 형식화와 제도적 무력감 개선, 중재자의 부담 완화를 위한 제도적 장치, 권력 구조와 위계적 문화의 공정성 훼손 차단, 공공 지원체계 구축, 예방 교육 및 사후 보호 강화, 중재자 전문성과 회복력 지원을 정책 과제로 제안하였다. 본 연구는 피해자 중심을 넘어 직장 내 괴롭힘 사건 중재자의 경험을 통해 제도의 구조적 문제를 드러내고, 제도의 신뢰성과 수용성을 높이는 실천적 방향을 제시했다는 점에서 의의가 있다.

This study examines limitations of the workplace bullying remedy system in social welfare facilities by focusing on the experiences of grievance officers and grievance experts who mediated such cases. Drawing on in-depth interviews with two grievance officers and three grievance experts, the study employs thematic analysis. The findings show that formalized and prolonged procedures produced institutional helplessness and emotional exhaustion for both victims and mediators. Mediators faced persistent tensions between effective initial response and maintaining neutrality, while organizational power structures, hierarchical workplace cultures, and external interventions undermined procedural fairness. In addition, insufficient public financial and institutional support weakened effective remedies, alongside symbolic preventive education and inadequate post-incident protection. By centering mediators’ perspectives, this study highlights structural weaknesses of the remedy system and suggests practical directions for enhancing institutional credibility and acceptance.
