스테이블코인의 무역대금 결제 상 법제화 방안에 관한 제언

Suggestion on the Legalization Plan for the Stablecoin Trade Settlement

본 연구는 스테이블코인(stablecoin)을 활용한 무역결제의 가능성을 실무·제도 관점에서 분석하고, 한국의 법제 보완 과제를 입법·하위규정·감독지침·표준계약·파일럿 설계로 구성된 패키지로 제시한다. 스테이블코인 무역결제는 지갑 간 직지급형, 결제대행·에스크로형, 서류·물류 이벤트 연동형으로 유형화되며, 단기적으로는 규제준수와 증빙 부담을 중개 인프라에 흡수할 수 있는 방식이 가장 현실적인 상용화 경로로 도출되었다. 수출입기업 인터뷰를 통해 얻은 실무적 병목은 외국환 규율의 예측가능성 부족, 현금화 경로 불확실, 무역거래 목적 확인 중심의 AML 체계 미비, 기업 내부통제·커스터디 부재, 회계·세무·감사 증빙 표준 부재, 분쟁·환불·사고책임 배분의 불명확성으로 수렴하였다. 이에 본 연구는 외국환거래 규정의 명시적 포섭과 목적별 보고체계, 결제용 스테이블코인 발행·준비금·상환권 규율, 결제대행·에스크로 사업자 라이선스와 책임·보험체계, 회계·세무·감사 증빙 템플릿, 전자서류·데이터 기반 지급 조건의 법적 인정 및 예외처리 절차를 포함하는 단계적 로드맵을 제안한다.

Purpose: This paper proposes a system improvement for the practical introduction of stablecoins. Research design, data, and methodology: This study analyzed the feasibility of trade settlements from a practical and institutional perspective, and presented Korea’s legal supplementation tasks as a package comprising legislation, sub-regulations, supervisory guidelines, standard contracts, and pilot design. Results: Stablecoin trade settlements were identified as the most realistic commercialization path that could absorb regulatory compliance and the burden of evidence into intermediary infrastructure. Conclusions: This paper proposes a roadmap that includes explicit inclusion of foreign exchange transaction regulations and reporting systems by purpose, regulations on the issuance, reserve, and repayment of stable coins for settlement, licensing and accountability systems for payment agencies and escrow operators, evidentiary templates, legal recognition of electronic documents and data-based payment conditions, and exception handling procedures.
