Issues in UCITA and Computer Information Transactions with American Firms

Given the development of the telecommunications industry, the existing acts could no longer control computer information transactions. Therefore, the US established the Uniform Computer Information Transactions Act (UCITA) after years of preparations. the promotion of UCITA had been very slow since it was established mainly in favor of licensors. Likewise, other problems occur such as, Korean consumers pursuing computer information transactions with American firms through websites may also be affected by UCITA. Therefore, Korean consumers should understand the problems of UCITA particularly the fact that UCITA was drafted in favor of suppliers rather than consumers. In addition, one should check closely the contract terms first before singing to avoid being at a disadvantage. For their part, the Korean government should also protect consumers by inserting clauses in reaction to UCITA into the Electronic Information Transactions Act currently being developed and speed up the establishment of this act.
