A Study on the Trend of Developments of the Electronic Bill of Lading

At last, the prolonged discussions on the electronic bill of lading seem to have come to an end with the Bolero Bill of Lading. This paper tackJes the trend of developments of the electronic bill of lading and some important legal and practical aspects of the Bolero Bill of Lading with focus on the function of transfer of the contract of carriage which it has to be a negotiable instrument. As far as the electronic bill of lading is concerned, international unification is only feasible if nations and their international traders not only agree on the unifornlity of the medium, and on fOlm and content of the messages that can be registered, but also on unifonnity of legal consequences. From that perspective, since the Bolero Rulebook which aims at creating a globally recognized electronic bill of lading provides for a choice of law, a waiver of the right to the paper bill, the transfer of con1Tactual rights and duties, and the traosfer of the title to the goods while in transit, the Bolero system based on this Rulebook will make an important contribution to unifying international(paperless)trade.
