Legal Issues concerning Free Economic Zones

This paper is prepared for presentation in an academic seminar of the Korea Public Land Law Association. This is planned to address legal issues involved in free economic zones under the theme "legal issues on the transfer of the administrative capital and the land policy of the new government". This study includes the history and analysis of "the Act on Designation and Management of Free Economic Zones" enacted for the introduction of free economic zones. This contains the comparative study of the free economic zones under the said Act and the free zones under the existing domestic laws, such as duty-free zones, free trade zones, free international cities, foreign investment zones, etc. This paper points out the said Act has the following two problems in the light of public land law. First, in spite of the precedence of the said Act over other Acts in the development plan, it is likely to pose many problems in putting the plan under the said Act in practice. Secondly, the said Act has many legal problems In the methods and procedures for designation of free economic zones. Based on understanding of the above problems, this study presents various policy measures for legislative reform thereof.
