This paper is an attempt to study on the master plan of instructing the control plan like zoning or subdivision control etc. and providing the policy as in the Law of Urban Planning in the U.S.A. Zoning Was the center of urban planning in the history of U.S.A, but with the urban sprawl phenomenon and environmental problems in the 1970s the system of urban planning law needed to be established in a way to guard against them in a legitimate and systematic way. The position of 'Constitution' in connection with the Land Using Control was imposed to a master plan based on the background above. That is, today each state usually obliges all controls like zoning to consist with the master plan, and nullified all control plans against them. In particular as the growth management policy was attempted to develop the urban balancing with the public facilities, the importance of master plan was more stressed as the basis of the legitimacy and a control means against the discretional land control use. The study on the legal personality and the position in accordance with a master plan as in the law of urban planning in the U.S.A suggests many things to Korea, where the control plan like the zoning system is centered, and is necessary to indicate the direction toward setting the Law of Urban Planning in Korea.
