A Study of Navigational Responsibility for Collision Casualties in Specific Defined Fairway Areas

Generally, when navigating on specific defined fairway, vessels have to comply with the Traffic Sailing Rules of the concerned countries and COLREG 1972. In this regards, this paper has studied for the navigational responsibility of the collision accidents which occurred at the specific defined water area including the Traffic Separation Scheme. For the analysis of the appointments of liabilities of collision, this paper analyzed the case-study of the data of maritime court justices for the collision accidents produced by the General Office of Maritime Accidents Inquiry of U.K and R.O.K In this connection, this study clarified that the collision occurred within a traffic separation scheme as defined by COLREG, the general sailing rules apply firstly instead of the detailed traffic separation regulations and also the wrong lane located vessel was more to blame for the collision than the other vessel when collision accidents occurred in the conditions of one vessel had crossed the separation scheme so that she was in the wrong lane. Meantime all of the vessels must be complied with the traffic regulation defined by the countries and also to keep a safe speed, a good lookout and appropriate maneuvering signals in every circumstances.
