북한이탈주민 관리를 위한 공법적 과제

The protection and management of the defectors from North Korea is the most important task for unification of Korean Peninsula. Defectors from N. K trend to rapid increase since the 21th century and they may increase in a large scale if the politic and the economic status change. It is complicate problems that protect and manage defectors from N. K effectively, because they have contradictory legal status and nationality. That is, They are Korean people on the basis of Constitution but they are North Korean people on the review of international law. Though they are criminals, They must be protected and be admitted into Korea by government. then be passed judgement, if necessary.<BR> We should realize that the whole process from the defectors` generation, to their staying in a third nation, to entering South Korea and to settling there is closely connected single one, and it is very important to have the defectors settle successfully in South Korea by taking connected and synthetic measures to help them in that we can accomplish social integration between South and North Korea more easily in this way.<BR> It has been changed that legal system for protecting and settlement of defectors from North Korea in accordance with conditions of Korea since Korean War. We can get living lesson by German`s similar experience. This thesis brings forth some alternative proposals to manage and protect defectors from N. K<BR> Firstly, thorough inspection of entry procedure and joint trial. Secondly, systematic classification of defectors to give more effective support to protect them. Thirdly, set up some refugee`s camps in rural area to substitute for defector`s training school. Forthly, improvement of police protection and management. Fifthly, it is necessary to establish a supporting network organization by pan-government and civil professionals, to reserve enough fund to protect them. Therefore, it is believed that social integration of two Koreas in the future depends on whether we succeed in dealing with the defectors.
