경찰재량의 본질과 사법통제 - 미국의 경찰재량 통제방식에 대한 판레 검토를 중심으로

오늘날 평온을 유지하는 질서유지자로서의 경찰 역할이 점차 강조되고 있으며, 경찰재량을 적절히 행사하도록 통제하는 일은 중요한 현안문제가 되고 있다. 효과적인 경찰권의 행사를 위해 경찰재량은 반드시 필요한 것이지만 적절한 통제가 이루어져야 한다. 경찰재량이 경찰작용에 있어서 택할 수 있는 수 개의 대안 중 하나의 선택을 행함에 있어서의 효과적인 제한을 뜻한다고 한다면, 효과적으로 경찰직무를 수행하기 위해서는 경찰관의 재량범위 내에서 합리적 결정을 할 수 있도록 인정해 주어야 한다.<BR> 형사사법체계 안에서 내려지는 중요한 결정들은 법정이나 사무실에서 이루어지는 것이 아니다. 일반적으로 경찰재량의 행사야 말로 형사사법체계에서 이루어지는 첫 번째이며 가장 중요한 결정이 되기 때문에 경찰재량의 본질을 고찰하고 이를 적절히 통제하여야 한다.<BR> 경찰재량의 본질은 결정재량이나 정책수립재량， 집행재량 중에서 집행재량에 속한다. 이 논문에서는 집행재량으로서의 경찰재량을 적절히 통제하기 위한 사법심사의 절차를 검토하였고 미국 최고법원의 경찰재량과 관련된 대표적 판례를 분석함으로써 기본권 침해를 방지할 수 있는 방안을 모색하고자 하였다. 경찰재량을 적절히 통제하는 일은 법아래 평등을 실현할 수 있는 가장 중요한 절차라고 하겠다.

Two major views of the role of the police exist. One is the police are crime fighters concerned with law enforcement(crime fighting), the other is the police are order maintainers concerned with keeping the peace and providing social services to the community(order maintenance). The police have historically overemphasized their role as crime fighters and played down their more common work as keepers of the peace and providers of social services, simply because our society proffers rewards for crime fighting but cares little for the peace-keeping and providing services. The proper control of discretion is one of the major challenges facing police today. But police discretion is an extremely necessary part of police work.<BR> If we define police discretion is a effectiveness limit in course of making a choice among some alternatives of police action, We have to approve police officer`s rational decision for prove effectiveness of police discretion.<BR> There are several reasons why the police exercise discretion. If the police attempted to enforce all the laws all the time, they would be in the station office all the time and would not be on the street maintaining order. Because of political realities, legislators pass some laws that they do not intend to have strictly enforced all the time and they pass some laws that are vague, ill-defined, making it necessary for the police to interpret these laws and decide when to apply them. Moreover, most violations of the law are minor, for example traffic violations, and do not require full enforcement. So the complete enforcement of all the laws all the time would alienate, overwhelm the public from the entire criminal justice system.<BR> The police officer is genarally the first decision maker in the criminal justice system and is often the most important. It is essential to review the nature of police discretion, to control police discretion properly by judicial system. The nature of police discretion is executing discretion. In this paper, I`d like to review American established judicial precedents of leading case to control police discretion. Especially to control police discretion is the most important procedure to realize equality under the law.
