According co the Korean Constitution, Korea has made a political choice in favor of free market system. Free Market system helps Consumers co make tight choices. Economic Acrors might have the right co compete also. But too rigorous and competitive struggles result in the elimination of rivalry and the infringement co the right of consumers. The Practice of the Unfair Competitive Advertisement deprives the honest competitor of a sale and tricks the consumer into buying what he or she does not want.<BR> To prevent these demerits, the Korean legal system invented the institution of antitrust law. The Korean Antitrust Law about Advertisement prescribes some kinds of standards of unfair competition in practice of Advertisement.<BR> One of the unfair competitive advertisement is unfair comparative advertisement. The meaning of Unfairness is not dear. In addition, the Standards of the Unfairness of comparative Advertisement is not yet established in cases, either.<BR> In my opinion, the protection of consumers has to be the essential essence of the standards as well as the interests of competitors.
