군 내 사망사건 중 의문제기 감소방안에 대한 연구 - 자살을 중심으로

한국군에서 발생하는 사망사건은 점차 감소하고 있으나 이중 자살이 차지하는 비중은 점차 증가추세에 있다. 더욱이 인권에 대한 관심이 어느 때 보다 강조되는 현 상황에서 자살의 원인에 대한 유가족의 의혹제기와 군 수사에 대한 불신 등은 해소되기 보다는 더욱 증폭되고 있다. 이러한 의혹의 증폭은 오히려 이를 해소시키기 위한 국가기관에 의한 재조사 과정에서 더욱 심각하다. 앞으로도 이러한 현상은 모병제가 아닌 국민 개병제를 채택하고 있는 한국군의 여건과 군에 대한 불신과 의혹의 눈길로 바라보고 있는 국민, 유가족의 인식에 근본적 변화가 없는 한 앞으로도 지속될 것이다. 군에서 자살사건이 발생하였을 때 이를 원만히 처리하기 위해서는 근본적인 문제점이 무엇인가에 주목하여야 한다. 우선 유가족이 군의 수사에 근본적인 불신을 보이고 있는 이유 중에 하나는 군이라는 조직이 가지고 있는 폐쇄성과 특수성에 기인한다. 근본적으로 군의 수사체계나 사법체계에 대한 근본적 불신을 가지고 있는 것이다. 그러므로 제도적으로 민간에 의한 군의 수사체계는 감독을 받을 수 있는 시스템을 가질 수 있어야 한다. 또한 유가족이 가지고 있는 현실적 불만이 과연 무엇인가에 대한 접근이 불가피하다. 유가족이 가지고 있는 불만은 명예에 대한 측면과 금전적 보상에 대한 측면으로 구분될 수 있다. 본 논문에서는 이러한 점에 주목하면서 군에서 발생할 수 밖에 없는 자살사건을 원만히 처리하기 위한 실현 가능한 정책적, 제도적 제안를 제시하고자 한다.

The deaths which occurs at South Korean military forces are diminishing gradually, but the percentage of suicide is increasing now.<BR> Under the present situation where the interest regarding a human rights is emphasized, doubt proposal of the bereaved family against the cause of suicide and the distrust against the army investigation are amplified more rather than diminished. Amplification of doubt is more serious from the reexamination process due to the national institution. This phenomenon will sustain until Korean authority make decision adopting the volunteer system and change to recognition of the citizen and the bereaved family to military Justice system has happened. For solving suicide case in military, it is important to search what are basic problems. The reason bereaved family have suspicion to military investigation due to closing characteristic and peculiarity of military. They do not trust the result of investigation or don`t want to believe the suicide. Two main reasons are honor and money. The bereaved families want the honor of the son and expects a substantial money compensation. Through the article, It will be suggest the realization presentation of the policy and system proposal which is possible.
