경찰 수사 환경 개선 및 효율적 수사요원 운용 방안

다양한 분권화의 욕구가 제기되고 있는 오늘날의 한국사회의 각 분야 중 치안행정 역시 예외는 아니다. 치안행정은 국민의 생명과 재산의 보호, 그리고 국가 형벌권의 행사라는 중요한 문제와 맞물려 있는 사안이므로 분권화 여부를 섣불리 결정할 수 없는 민감한 분야이다. 그러나 이제 분권화의 흐름은 실행할 것인가의 여부를 떠나 실행하되 어떻게 해 나갈 것인가를 하는 단계로 접어 든 듯하다. 경찰행정 중 경찰의 수사 환경과 수사요원의 운용의 효율적 운용문제는 보는 시각에 따라 여러 가지 주장이 있을 수 있다. 특히 수사권 독립이라는, 한 편으로는 크게 관계가 없을 것 같이 보이는, 명제가 얽혀 있는 관계로 이 분야에 대한 논의는 많은 논란 속에 진행되어 왔다. 그러나 참여정부가 들어서고 난 이후부터는 급속도로 분권화를 해야 한다는 분위기로 전환되고 이제 분권화라는 명제는 기정사실화되었다. 즉 경찰을 둘러싼 수사 환경과 분권화에 대비하기 위한 경찰수사요원의 효율적 운용이라는 측면이 보다 구체적으로 논의되어야 할 시기에 이르렀다.<BR> 분권화와 연계하여 경찰조직에서 고려하여야 할 분야는 수사 분야 이외에도 적지 않을 것이다. 그러나 경찰의 여러 기능 중에서도 수사 분야는 외적으로 경찰 활동의 상징적 의미를 가지고 있고 실질적으로 국민의 인권과 직접적 연관을 가지고 있으므로 국민들의 관심을 끌고 있는 분야이다. 경찰수사에 있어서 분권화가 가지는 의미와 영향에 대한 정확히 분석과 방향 설정은 필수적이다. 중앙에서 지방으로 이양되는 분권화의 시행에 따른 현상은 다음과 같다. 행정업무의 지방 분산으로 인한 경찰수사의 정치적 중립성과 검찰에 집중된 수사지휘 권한의 현실화, 그리고 중앙경찰에서 지방경찰로 이양되는 수사권한의 운용을 위한 방향의 정립 등이다. 무엇보다도 차제에 열악한 수사요원들의 업무여건과 수사요원의 인력구조나 승진문제 등 산적한 각종 문제를 해결하기 위한 대안이 제시되어야 할 것으로 본다. 본 고에서는 발생 범죄의 증가나 사회제도의 발전 속도에 비해 상대적으로 제자리 걸음을 하고 있는 경찰수사조직의 문제점을 조직관리와 인력, 그리고 제도적 측면에서 살펴보고자 한다. 아울러 수사요원의 승진에 대한 문제점과 수사조직의 정상적 관리를 위한 계급구조문제, 업무의 비전문화 역시 문제점으로 지적되었다. 새로운 패러다임에 적응하기 위해서는 경찰 수사조직과 수사권 운용을 현실화시키고 보다 구체적인 제도 개선을 통하여 경찰조직 스스로가 이에 따른 변신을 적극적인 시도를 할 때라고 본다.

The desire of decentralization is rising from every sphere of Korean society. Public safety administration is important aspect that is related to the protect of life and property of citizens and processing of national punishment. Among the public safety administration, the police investigation surroundings and application of investigator have been discussed for years.<BR> According to sight of view, there are many different kinds of insist and discussion about this matters how improve the police investigation atmosphere and what is the best way to applicate the investigator effectively. After Noh`s government started, the `decentralization` is seems to be realized. There are many kinds of police functions that are related to decentralization. Among these, the investigation function is typical and symbolic activity of police, because it is related to human right of citizen directly. The decentralization will result to transfer the power and right from the central government to municipal including police affairs and to control and balancing the investigation of law enforcement between prosecutor agency and police bureau. If authority want to make sure improvement of police investigation atmosphere and application of investigator, it is need to comprehend the meaning and effect of decentralization to these matters exactly. It is needed to consider the realization of investigation and weak working condition of investigator and organization structure, man power management, promotion problems. Under new paradigm, ROK police bureau should consider and insist the change of police investigation structure and system for themselves.
