現行 道路交通法의 實務適用上 問題點에 關한 考察

2005년 5월 31일 도로교통법이 21년 만에 전면적 개정을 통하여 법 집행의 實效性을 확보한 사안으로 발전하였다고 볼 수는 있으나 실무 적용상에서는 여전히 도로 및 교통여건의 변화를 충분히 반영하지 못하고 있어 개선해야할 문제점이 있다.<BR> 본 논문에서는 이와 관련, 몇 가지 문제점을 지적하고 개선방안을 제시하고자 하였다. 특히 범칙금 제도와 관련, 이의제기 시 도로교통법 관련 규정을 명확히 제시하여 의견을 진술할 수 있도록 법조항을 明示하여야 한다. 이 외에도 移動式 카메라에 의한 過速 ?束, 운전중 휴대폰 사용에 관한 적절성 판단 여부, 주취운전 단속 방법의 답습, 수시 시행되는 赦免등으로 위화감 조성은 물론, 형평성의 논란 여지도 충분하다.<BR> 개선방안으로, 일단 과속으로 적발되었다면 빠른 시간내(30분 혹은 1시간 이내) 관련 교통시스템을 활용하여 운전자가 인지토록 통보하는 등 관련 법규를 폐지하거나 개정하여야 한다. 구체적 사안으로 제17조(속도규정), 49조(운전자의 준수사항), 제150조의 2(飮酒測定不應罪 등), 제82조 (운전면허의 결격사유)에서 규정하고 있는 관련 법조항들의 실무적용에서 현실적으로 개정되어야 할 부분에 대해 구체적으로 언급하였다. 모처럼 전면적으로 개정ㆍ공포된 도로교통법이 ‘06년 6월 1일부터 발효되고 있는데 이러한 부분적인 관련 조항의 실무적용에 있어서는 좀 더 세밀하게 적용시킬 필요가 있는 사안이다.
