범죄진압 및 수사와 관련하여 담당 경찰관들은 그 절차와 결과에 있어 공정해야 하고, 시민의 인권을 존중하며, 또한 전문적인 수사가 이루어질 수 있도록 해야 한다. 경찰은 국민의 안전과 공공의 안녕 그리고 사회질서 유지를 목표로 하는 바, 이러한 절차 및 과정들을 통해 시민들의 신뢰성을 높일 수 있다. 본 연구는 수사경찰관들의 범죄수사 활동에 대한 시민들의 신뢰성 확보를 목적으로 ‘수사이의신청제도’에 대해 살펴보았다. 경찰 수사과정에서 발생하는 문제를 해결하기 위한 방안으로 경찰단계에서 수사이의신청제도가 시행되고 있지만 이 또한 시민참여제도의 활성화 측면에서 다양한 문제를 내포하고 있다. 현행 수사이의신청제도는 이의사건에 대한 낮은 수용율과 인용율, 제도의 실효성 확보, 심의의 효과성과 공정성 확보, 위원회의 독립성과 전문성 보장의 문제와수사이의신청제도의 운영상 발생하는 문제들이 지적되었다. 형사절차의 시민참여와 경찰수사의 공정성을 확보하기 위해서는 현재의 수사이의 신청제도에 대한 개선이 요구된다. 수사절차의 공정성과 신뢰성을 확보하기 위해서는 수사이의신청제도의 실효성 확보가 시급하며 이를 위해서는 무엇보다 수사이의심사위원회의 구성과 운영에 있어 독립성과 객관성을 유지하고 전문성을 갖출 수 있는 여건이 마련되어야 한다. 또한 수사이의조사팀과 청문감사관실의 업무분장에 대한 조정이 이루어져야 하며, 수사경찰의 수사활동 독립성 보장과 수사관의 직무와 관련된 사건에서 담당수사관의 제척․기피․회피사유를 구체적으로 규정해야 한다. 이와 더불어, 수사이의를 신청한 자의 이의사유를 청취하고 진술할 기회를 제공해야 하며, 강압적이고 권위적인 수사방식에 대한 개선이 요구된다.

Also, the investigation must provide to the people for human rights friendly and professional and quality and quantity of the investigation because the police isolate the offenders to maintain the welfare of the people and public order in society. This process is shown to the due process because people connect directly to reliability. In this study, a improvement of objection for the investigation to establish the reliability in criminal investigation activities of investigation police officers. Police investigation"s improvements are required in various forms that the civilian advisory board operations, independent of the police investigation activities, complaints results of the investigation about the process and handling, investigation improper replacement, providing the opportunity to state its reasons for unsatisfactory results of the investigation. Therefore, to establish the fairness and the reliability of criminal investigation, First, the Objection Investigation Team and Hearing Inspection Unit avoid duplicate work and must quickly adjust to information requested by the petitioner. Second, the Investigation police should be guaranteed independence from administration police to provide services the professional and prompt investigation. Third, the appeals for the investigator to be guaranteed by this system about the illegal and unjust conduct the investigation. Fourth, the limitation of exclusion, challenge, and refraining should be regulated in the case of job-related to investigators. Fifth, the applicant"s reasons for its direct listening, and must be given the opportunity to be heard.
