본 연구는 2009년 양형기준이 적용되는 8개의 범죄군 중, 성범죄의 세부항목인 13세이상대상 강제추행범죄의 양형기준 적용현황을 분석한 것이다. 본 연구에 사용된 자료는 대검찰청의 사건처리정보시스템(PGS)의 자료에서 획득된 13세이상대상 강제추행범죄 사건의 모수를 기본으로 하였다. 2009년 7월1일~2010년 6월 30일까지 공소제기 된 사건 중1심 유죄판결을 받은 347건의 13세이상대상 강제추행죄가 분석에 사용되었다. 13세이상대상 강제추행 범죄의 유형별 형량분포, 부합률, 양형인자의 적용빈도와 영향력을 기술통계와 t-test, 그리고 다변량회귀분석을 평가하였다. 전체적인 모집단대상 회귀 분석 결과 양형기준에서 명시하고 있는 다양한 양형인자 들 중에, 가중인자들의 영향력이 높았으며, 특히 특별가중요소들의 상대적 영향력이 높았다. 더욱 구체적으로 일반강제추행범죄의 독립적 회귀분석결과, 특별가중요소인 성폭법제7조의 범행형태, 일반가중요소인 심신장애야기와 청소년성보호법7조에 해당하는 인자들이 양형변이를 설명하는데 유의미한 인자로 나타났다.
The purpose of this study is to analyze the status quo of application of the first korean sentencing guidelines for sexual molestation. The data were obtained from the Prosecutorial guideline System(PGS) of the Supreme Prosecutors" Office, Republic of Korea. Based on the PGS data archive, we selected available 347 population cases for sexual molestation offenders who were sentenced from July 1st, 2009 to June 30th, 2010. To describe the type of the crime, we mainly used basic descriptive statistics, t-test, and ANOV. In addition, we investigated the power of explanation of the current sentencing guideline of sexual molestation using OLS regression. The results contain the frequency of the each sentencing factor, type of the decision, length of the sentence, the compliance record, mean difference of the length by the sentencing factor in the context. Moreover, the power of the influence of the sentencing factors are showed in the context. The regression result is showing that the model of the sentencing factors for sexual molestation is needed to be amended as indicating the is not enough. Also we found that the special aggregation factors have relatively the strongest power among the factors for the model of the sexual molestation. The detailed significant factors and detailed policy implication will be discussed in the context.
