Dating violence is the perpetration or threat of an act of violence by at least one member of an unmarried couple on the other member during dating or courtship. Dating violence can take a number of forms: sexual assault, sexual harassment, threats, physical violence, verbal, mental, or emotional abuse, and stalking. Dating violence has been viewed as a private matter that need not involve the government or criminal justice. Police response to dating violence is very important to protect victims and prevent to commit a second offense. From 2017, Korean National Police have tried to deal with dating violence more actively such as creating 112 code for dating violence, the protection of the victim by patrolling and warning to the offenders. Despite of the police efforts, it is not certain that those measures are effective to deal with dating violence. The aim of this study is to clarify this issue as follow. First, It is required that reporting rate of dating violence be increased to understand and deal dating violence effectively. Second, police department improve the perception of police officer on dating violence to cope with dating violence. Third, new protection system for victim should be prepared in detail based on the characteristics of dating violence. Fourth, the offenders should be regulated more strictly to prevent the crime from reoccurring and to protect the victim. Lastly, the law regulating dating violence should be enacted in near future including urgent action of police officer.
데이트 폭력은 성폭력과 같이 피해자가 신고를 하지 않는 경우가 많다. 그래서 그 실체를 파악하기 더욱 어렵다. 데이트 폭력에 의한 강력범죄가 사회적 문제로 대두된 것도 비교적 근래이다. 데이트 폭력 사건처리에서 가장 중요시되어야 하는 지점은 피해자의 보호와 재범방지이다. 이를 위해서는 데이트 폭력을 처음으로 신고 받고 초동조치를 하는 경찰의 역할이 중요하다. 경찰은 2017년 3월부터 데이트 폭력 112신고에 별도의 코드를 부여하는 등 개선대책을 시행하고 있다. 본 연구에서는 데이트 폭력에 대한 경찰의 대응 실태를 살펴보고 다음과 같은 개선방안을 제시하였다. 첫째, 데이트 폭력에 대한 인식도가 개선되었으나 여전히 신고율이 저조하다. 신고하지 않는 이유를 분석하고, 관련기관과 협력하여 데이트 폭력이 범죄라는 것과 처리절차 등을 적극 홍보해야 할 것이다. 둘째, 112신고사건 처리에서 데이트 폭력 코드를 신설함에 따라 제1차적으로 출동하여 대응하는 경찰관들의 인식도 많이 개선되었다. 그럼에도 불구하고 일선현장에서 데이트 폭력 피해자를 대하는 태도 등이 본질적으로 변하지 않으면 한계가 있으므로 데이트 폭력에 대한 인식을 바꾸어야 한다. 셋째, 피해자 보호기준을 구체화하고 강화하여야 한다. 피해자의 위험성 및 여건 등을 고려하여 다수의 보호조치를 상호 보완적으로 실시하고, 특히 보복이 우려되는 경우 신변보호를 강화하여야 한다. 넷째, 가해자에 대한 조치 및 관리를 개선하여야 한다. 형사처벌 여부와 상관없이 가해자에 대한 경고를 통해 경찰이 예의주시하고 있으며, 처벌법규 등을 인지하게 함으로써 재범행위를 자제하도록 유도할 필요가 있다. 다섯째, 지역경찰과 형사 등 관련 기능간 협력체계 확립하여야 한다. 마지막으로 데이트폭력 관련 법률을 조속히 마련하여야 한다.
