The School Health Act: Problems and Improvement Measures

Purpose: The present study aims to reinforce legal means for effective health promotion in schools by examining the School Health Act in light of Stone’s health promotion model ACCESS(1990). Methods: The study analyzed the School Health Act, along with its Enforcement Decree and Enforcement Rule, in terms of ACCESS: Administration, Community, Curricula, Environment, and School Services. Then, problems were identified and improvement measures proposed. Results: We identified the following problems with the current School Health Act. As regards Administration, Article 15 establishes that is not in accordance with student population. As regards Community, Article 17 remains dead letter law. As regards Curriculum, Article 10-3 in the Enforcement Rule is an inadequate optional rule for administrative realization. As regards Environment, Articles 10 and 10-2 in the Enforcement Rule are entirely different regulations. As regards School Services, the health teacher duties in Article 23-3 of the Enforcement Decree should be revised to ensure professionalism. Conclusion: Physical examination rules provide inadequate solutions for addressing eyesight and oral hygiene problems, which presently constitute the biggest health challenges in schools. Placement regulations for health teachers have a lack of rational systemic relations between upper-level and lower-level laws.(190)
