본 연구는 교육정보공개법의 정책 목표를 비판적으로 검토해 보았다. 이를 위해 먼저 교 육정보공개법안의 정책 목표를 맥락적으로 파악해 본 다음, 이를 명시적으로 표방된 정책 목표의 실제 의미와 비교해 보았다. 연구 결과는 다음과 같다. 교육정보공개법안의 정책 목 표를 동반 발의 법안과의 관계 속에서 파악해 본 결과, 그것은 학업성취도평가 결과의 공시 를 통한 학교 간 경쟁 유발로 나타났다. 교육정보공개에 관련된 선행 담론을 통해 볼 때, 교 육정보공개법안이 전제하고 있는 교육 문제는 교육에 대한 ‘규제’나 ‘평준화 정책’ 같은 비 시장적 질서였다. 한편, 교육정보공개법안의 표방된 정책 목표는 ‘국민의 알 권리 보장’, ‘학 생의 학습권 신장’, ‘교육격차의 해소’ 등과 같이 공공선의 언어로 진술되어 있었다. 이러한 정책 목표들은 실제로는 부차적인 성격의 정책 목표이거나 ‘학교선택권’의 신장, ‘경쟁을 통 한 학업성취도 격차의 해소’ 등을 의미하는 것으로 결국 맥락적 정책 목표와 일맥상통하는 것이었다. 이러한 연구 결과는 ‘가려진 교육 정책 목표’의 존재와 교육 정책의 결정 과정에 사용되는 언어 전략의 유효함을 보여준다. 교육정보공개법의 제정은 규제 완화, 선택권 확 대, 정보흐름 활성화라는 신자유주의적 교육개혁 기본 구조의 완성을 의미하는 것이었다. 그 러나 신자유주의 이념을 교육에 적용하는 것에 대해서는 신중한 재고가 필요하다.
The purpose of this study is to identify the policy goal of the Education Information Posting Act (EIPA) in South Korea. In this paper, an educational policy is considered as specific solution for specific educational problem that policy makers recognized from particular point of view. So, this study investigated the policy goals in the context of policy production. The results of this study are as follows: Considering the bills accompanied by EIPA and preceding discourses, substantial goal of EIPA bill was disclosure of school achievement for inducing school competition. The claimed goals were articulated in the language of general public good such as ‘right to know’, ‘right to learn’, ‘elimination of education gap’ etc. However the real meanings of these claimed goals have a thread of connetion with the substantial goal. The implications of these results are the existence of ‘hidden educational policy goal’ and the importance of linguistic strategies in the policy process. The passage of EIPA implies that basic structure of neo-liberal educational reform, including deregulation, expanded right of choice, and active flow of information is completed. Nevertheless, to apply neoliberal principles to educational reform should be carefully reconsidered because it can lead to side effects much more than positive effects.
