본 연구는 일본의 1947 교육기본법과 2006 개정교육기본법의 내용을 비교？점검하여 교 육적 의미를 분석하고 그것을 통하여 교육기본법의 가치를 궁구해 보고자 한다. 전후 교육 기본법은 현대적 일본 교육의 시작점으로 볼 수 있으며, 그 안에는 현대적 의미의 교육 인 식과 상통하는 면모들이 많이 담겨 있다. 또한 세계 대전에 대한 반성과 일본의 재건에 대 한 의지가 반영되어 있다. 그러나 시대적 한계를 엿보게 하는 대목도 눈에 띠는 것도 사실 이다. 개정교육기본법은 경제 강국으로서의 일본의 자부심이 담긴 실제적 교육헌법이다. 그 속에는 보수적 측면과 진보적 측면의 교육사조가 잘 조화된 현대적 의미의 교육 이념이 녹 아 있다. 다만, 전후 교육기본법의 전문에 명시되어 있던 ‘평화를 희구하는 인간’이 개정교 육기본법의 전문에서 빠진 점은 아쉽다. 일본의 전후 및 개정교육기본법이 공통적으로 가 지고 있는 특성 중 대표적인 것은 교육의 기회균등이 매우 중시되고 있다는 점이다. 이 것은 일본이 민주주의 국가로서 평등교육과 복지교육을 구현하겠다는 의지를 표명하는 것으로 생각된다. 일본이 세계적 경제 강국이 될 수 있었던 것에서는 교육이 큰 역할을 했 으며, 여기에는 교육에 대한 일본 사람들의 엄정하고도 바른 인식이 바탕 되어 있다. 이것 을 기반으로 하는 교육기본법은 21세기 경제 강국으로서의 일본의 국가적 자신감을 바탕으 로 하여 구성된 체계적인 민주주의 교육법이라고 하겠다.
This paper purposes to research the value of the basic educational law of Japan through analysis and comparison between 1947 and 2006 basic educational law. 1947 basic educational law can be called the beginning of modern Japan education. In that, there are a frank self-examination to the world war and a will for national reconstruction. But there, we can feel a little limitation of age. On the other hand, 2006 basic educational law can be called true modern educational constitution. In that, there are educational ideals that mixed well by conservatism and progressivism. Merely, it is a great pity to exclude the word of 'peace'. In the basic educational law of Japan, it is remarkable to emphasize the equality of opportunity for education. It seems to expression of the will for equality and welfare in education. Education carried out a role as a base in making powerful economic nation for Japan. And here, there are strict and correct recognitions to education. The basic educational law founded by these recognitions is the well-organized democratic law that is based by national confidence as 21C's big nation.
