거주형 노인복지시설의 체질 전환을 위한 관련 법령 정비방안

A study on readjusting laws and regulations to reform constitution of residential welfare facility for the aged - Focus on protection of human rights for residents -

본 연구는 거주형 노인복지시설 노인들에 대한 인권과 권리침해를 방지하여 그들의 인권과 권리를 실질적으로 보장하기 위하여 과거 시설들이 가진 부정적 체질을 긍정적 체질로 전환할 수 있도록 관련 법령의 정비방안을 제시하는 것을 목적으로 하고 있다. 본 연구의 결과 거주형 노인복지시설 이용노인들의 인권 및 권리침해를 방지하고 시설의 부정적 체질을 전환하기 위한 관련 법령의 정비방안은 다음과 같다. 첫째, 시설 설치의 방해 금지 규정의 실효성 확보, 시설장 겸직의 폐지, 시설운영위원회의 의결기관화 등과 함께 새로운 시설복지옴부즈맨제도를 도입하도록 사회복지사업법령을 정비하여야 한다. 둘째, 노인복지법의 목적과 기본이념에 노인의 인권과 권리보장의 명문화, 시설운영간담회 규정의 폐지, 시설장 겸직허용 규정의 폐지, 입소제도의 계약제도화, 협약의료기관 및 촉탁의사운영 규정이 현실화 되도록 노인복지법령을 정비할 필요가 있다. 셋째, 노인장기요양보험법령은 그 목적 및 장기요양서비스 제공원칙에 수급노인의 인권과 권리보장의 명문화, 장기요양기관 정보 안내 규정을 수급노인들의 알권리와 시설선택권을 충실히 보장할 수 있도록 정비하여야 한다

This study is to propose revising laws and regulations regarding residential welfare facility for the aged. Eventually I suggested to change the out-dated constitution of facility in order to protect human rights for resident in welfare facility for the aged. This research led to the following conclusions: First, Social Welfare Services Act should be amended as follows: to assure the practical regulation for prohibition on obstruction of establishment of facilities, to abolish the clause of prohibition of concurrent office-holding by directors, to exercise operating committee s voting right and to introduce the ombudsman system. Second, Welfare Of The Aged Act should be revised as follows: to stipulate the purpose and fundamental ideas for human rights protection for the aged, to abolish the irrational clause of alternative operating committee, to abolish the clause of prohibition of concurrent office-holding by directors, to institutionalize the contract system for dispositions of entrance and to ensure the pragmatic regulations for operating cooperation medical organizations and non-regular facility doctors. Third, Act on Long-Term Care Insurance for the Aged should be reformed as follows: to stipulate the purpose and basic ideas for human rights protection for beneficiaries, to guarantee the right to be informed and the right of self determination to long-term care institutions.
