인권레짐에 기반한 비보호탈북청소년의 교육권 보장 방안

The human rights regime based on Right to education guaranteed ways unprotected defection of youth

본 연구에서는 인권레짐에 기반한 비보호탈북청소년의 국내외 관련 법률을 살펴봄으로써 변화하는 북한이탈주민의 동향에 대해 진단하고 복지사각지대에 놓여있는 북한이탈청소년의 문제를 예방하여 통일을 대비한 대한민국의 정책과제를 모색해보고자 한다. 탈북 청소년이 처한 교육권 침해 및 보장의 실태와 현황을 깊이 있고 정확하게 파악하여 장기적이고 실질적인 대책을 마련하는 일은 이들에게 제반 다양한 인권 영역 중에서도 교육권을 보장해 주는 것이 무엇보다 중요한 일이라고 볼 수 있다. 주요 연구방법은 기술적인 연구로서, 연구의 성과는 아래와 같다. 첫째, 법적· 제도적 지원 체계를 명확히 할 필요가 있다. 둘째, 실무와 일치하는 법률의 개정을 통하여 일치시킬 필요가 있다. 셋째, 청소년의 연령 범주 기본법을 개정해야한다. 넷째, 비보호탈북청소년의 국적취득을 개선시킨다. 다섯째, 의무 부모교육이 이루어져야한다. 결국 본 연구에서는 북한의 탈북자로 보호되지 않은 청소년의 교육에 대한 권리를 위한 표준을 제시하는 의의가 있다.

This research aims to propose the policies of the Republic of Korea in preparation for the unification diagnosis of defectors changing trends by looking at the domestic laws of the unprotected youth defection based on human rights regime. Therefore, examined the status of such unprotected youth defection law, right to education guarantee scheme based on the human rights regime in this study. The main research method was descriptive study and the research results are as follows: First, legal, institutional support systems should be clarified. Second, tamendments of laws and practices should be matched. Third, the Basic Law of the youth age category should be revised. Fourth, Improvement of North Korean citizenship of unprotected youth, Fifth, obligated parent education should be carried . Consequently, this study has a significance that suggests the standard for Right to education of Unprotected Youth as the North Korean Defectors
