긍정적 청소년 발달(PYD)과 소년사법제도에 관한 고찰

A Study on Juvenile Justice System and Positive Youth Development - with the focus on the Juvenile Justice System of U. S. -

소년보호 제도와 정책이 청소년의 범죄예방과 재범률에 있어서 만족할만한 성과를 거두지못하는 것은 그동안의 제도와 정책, 실천에 문제가 있었다고 보아야 할 것이다. 이에 따라 소년범죄의 현상과 원인에 대한 깊이 있는 분석과 기존 소년보호제도와 정책, 그 실천과정 및 그동안 추진해왔던 법과 제도에 적용된 이념에 대한 근본적인 재검토가 이루어져야 한다. 본 연구의 목적은 우리나라 소년사법체계의 발전에 기여할 수 있는 방안을 제시하는 것이다. 이를 위해 소년사법제도의 개념과 절차를 확인하고 긍정적 청소년 발달 이론을 살펴보았다. 특히, 미국의 소년사법제도와 절차, 그에 적용된 긍정적 청소년발달 이념을 확인하였다. 이를 바탕으로 긍정적 청소년발달 이념 적용의 어려움과 적용 절차, 적용 방안을 확인하여 우리나라 소년사법제도에 긍정적 청소년발달 이념의 도입가능성을 검토하였다.

They have not been able to reap the institutional and policy achievements of youth offenders and prevent re-flight. The purpose of this study is to present a way to contribute to the development of our country boy justice system. Check the concepts and procedures of the juvenile justice system. And I looked at the positive youth development theory that can be applied to juvenile justice. In particular, it was on the basis of positive youth development principles applied to the juvenile justice system in the United States confirm the difficulty of applying measures and positive youth development philosophy. This was reviewing the possibility of introducing positive youth development philosophy.
