국제사회복지 관련 비정부조직(INGO)의 해외 활동 지원을 위한 법제 연구

A Legislative Research to Support Overseas Activities of INGOs Related to International Social Welfare

한국전쟁으로 국제사회의 원조를 받던 우리 나라는 눈부신 경제발전을 통하여 국제사회에 원조를 제공하는 공여국이 되었다. 한국의 많은 국제사회복지 관련 INGO들은 해외에서 사회복지 활동을 수행하고 있으며, 이 규모는 크게 증가하고 있는 상황이다. 그러나 이에 대한 지원 법 체계는 비미한 상황이고, 지식관리에 기반한 법제 연구 및 법 체계 완비가 시급히 필요하다. 특히, 역량이 뛰어난 중소 INGO들은 민간 외교관으로서의 기여하는 역할에 비하여 현지활동에 여러 장벽에 대한 국가의 지원은 부족한 상황이고 폭넓은 활동의 증대를 보장하지 못하고 있다. 또한 INGO 실무자들에 대한 전문 인력 양성은 선언적 수준이고, 기본적인 보장체계를 갖추고 있지 못한 상황이다. 이를 위하여 다음과 같은 제언을 하였다. 첫째, 한국 INGO의 법적 지원을 강화하기 위한 법 체계가 개선되어야 한다. 둘째, 인증제도 등의 적극적인 지원체계를 도입해야 한다. 셋째, 해외 현지 활동 실무자에 대한 처우를 개선해야 한다. 넷째, 전문인력을 법적으로 규정하고 강화해야 한다. 다섯째, (가칭) 국제사회복지 관련 융복합 지식체계 구축을 위한 사후 연구가 필요며, 입법적 기틀을 마련하기 위한 지식 프로그램화가 필요하다. 여섯째, 한국사회복지사협회 및 사회복지법제학회 등의 사회복지 전문조직들의 정책 결정과정의 참여를 확대해야 한다.

Korea had been the recipient of international aid to the Korean War, but now it has become a donor to the international community through significant economic development. Korean INGOs are carrying out social welfare activities overseas, and this scale is increasing greatly. However, the legal system that supports INGO is in a no good situation, and it is urgently necessary to complete legal research and legal system based on knowledge management. In particular, small and medium sized INGOs who has excellent competence and their role as a civilian diplomat are blocked by various barriers to their local activities. Therefore, the support of the state is needed and the activities should be guaranteed. They should also provide professional education on international social workers and have a basic social security system. The following suggestions were made for this. First, the legal system to strengthen the legal support of INGO should be improved. Second, an active support system such as certification system should be introduced. Third, we need to improve the treatment of practitioners working overseas. Fourth, it is necessary to legally define and strengthen professional manpower. Fifth, it is necessary to conduct post - study to establish a complex knowledge system for international social welfare law (tentative name), and it is necessary to make knowledge program to establish legislative basis. Sixth, the participation of the social welfare professional organizations such as the Korean Association of Social Workers and the Academy of Social Welfare and Law should be expanded.
