자경주의에 대한 신사고와 융합학적 연구의 필요성

New Thinking of Vigilantism and the Necessity for the Convergence Study of It

이 논문의 목적은 자경주의에 대한 새로운 개념을 소개하고, 그 연구의 필요성을 제고하는 것이다. 대한민국과 같은 국민국가는 국민의 모든 생활이 경찰의 공권력의 지배와 통제에 따르는 것을 당연하게 생각하고 있다. 그럼에도 불구하고 사소한 경범죄는 물론이고 대규모 집회에서 보듯이 개인과 집단이 정의를 스스로 실현하고자 하는 경향은 허다하다. 이와 같은 자구적 노력은 그것의 성격에 따라 합법성과 위법성이 정해지지만, 국가권력이외에 실력행사가 있는 예는 회사, 종교단체, 노동조합, 주민자치회 등의 이름으로 조직화된 단체들이 구조화된 경우에서 어렵지 않게 발견된다. 정부가 그들의 모든 행위를 통제할 방법이 항상 유효한 것은 아닌 점을 감안하여 필자들은 자경주의에 대한 국내외 이론과 사례를 논할 것이다. 그 연구방법으로서 자경주의에 대한 새로운 개념을 어원과 문화 간 차이를 분석하는 방법으로 소개하고, 자경주의에 대한 해외 연구사례들과 국내 연구동향을 통해 정의론에 기초한 인문학과 사회현상을 다룬 사회과학의 융합학적 연구가 필요함을 주장한다.

This paper aims to introduce the new concept of vigilantism and raise the necessity for the research of it. The nation-states such as South Korea take it for granted that all the aspects of the people’s lives are governed and controlled by the police. Nevertheless, as seen in the massive rally as well as small crimes, there are many cases that have the tendency that some individuals and groups would like to realize justice. As to the self-helping efforts like this, their characteristics can say whether it is legitimate or not. However, the examples of showing force besides the government authority are discovered without difficulty in the structuralized groups, such as companies, religious gatherings, labor unions, residents’ association, etc. Given that the government cannot adequately control all the activities, the researchers will discuss the internal and external theories and cases of vigilantism. As a research method, the authors introduce new thinking of vigilantism by analyzing its etymology and cultural difference and insist on the need of the convergence study covering the humanities based on the theory of justice and the social studies working on social phenomena through the international case studies and the national trend of research regarding vigilantism.
