본 연구는 독일의 소년보호정책과 법적지원체계에 대해서 분석하여 비행청소년들의 재범예방을 위한 효과적인 실천방향에 대해 탐색하였다. 이를 위해 본 연구는 독일의 법, 서비스, 전달체계 등에 대해서 살펴보았다. 특히 본 연구는 가정의 적절한 돌봄이 어려운 비행청소년을 위한 사법형 그룹홈인 청소년회복지원시설의 운영모델을 독일의 청소년하임 사례를 중심으로 탐색하였다. 연구결과, 독일의 소년보호정책은 소년법원법과 아동청소년지원법을 토대로 응보적인 처벌에 목적을 두는 것이 아니라 건전한 사회구성원으로 성장하고 발달할 수 있도록 지원하는 교육과 회복에 관심을 두고 있다. 또한 소년보호서비스 전달체계는 청소년청을 중심으로 총괄조정이 이루어지고 있으며, 법원과의 협력체계가 잘 구축되어 있다. 청소년하임은 청소년대안시설로써 가정형태로 운영되고 있으며, 전문가에 의한 질적인 서비스를 통해 단순한 보호 수준을 넘어 교육, 치료, 회복, 자립까지 지원하고 있다.
This study analyzed the German juvenile protection policy and the legal support system, and explored the effective practice direction to prevent recidivism of juvenile delinquents. For this purpose, this study explored the legal system, juvenile protection policy, youth service, delivery system. In particular, this study explored the operation model of the youth recovery support facility, which is a judicial group home for delinquent adolescents who have difficulty in getting care from the family, focusing on the case of youth‐heim in Germany. As a result of the study, the German juvenile protection policy is not aimed at punitive punishment based on Juvenile Court Act and Child Juvenile Support Act, but is interested in education and recovery to support growth and development as a healthy society member. In addition, the juvenile protection service delivery system is being coordinated generally centered on the youth welfare office, and the cooperative system with the courts is well established. Youth‐heim is a youth alternative facility operated as a family type, through qualitative service by experts, it supports education, treatment, recovery, self‐reliance beyond simple protection level.
