인권 관점에서 살펴본 장애아동 성폭력범죄 판례연구

A Case Study of Sex Crimes on Disability Child in Light of Human Rights

본 연구는 장애아동 성폭력범죄 판례를 인권관점으로 살펴보고 이를 통해 장애아동 인권보호를 위한 정책적 개선방안을 제시하는 데 목적이 있다. 연구대상은 1심에서 3심까지 진행된 사건을 선택하여 인권의 기본 내용인 자유권, 평등권, 사회권 보장의 반영 여부를 알아보면서, 동시에 UN 장애인권리협약(CRPD)의 원칙들을 분석에 적용해 보았다. 그 결과 1심과 2심에서는 장애아동의 특성을 반영하지 않아 판결이 이루어져 평등권을 보장하지 못하고 있으며 사회권이 고려되지 않은 조건에서 자유권에 대한 부분을 판단하고 있었으며, CRPD의 원칙들에서도 어긋나 있었는데 특히 법앞의 평등과 사법접근성의 원칙이 반영되지 않았다. 반면에 대법원은 장애아동의 특성을 반영하면서 평등권, 사회권, 자유권을 보장하고 있었으며, 특히 CRPD의 원칙들이 잘 반영되었음을 알 수 있었다. 이러한 연구결과를 바탕으로 법조인들이 인권 관점을 적용하여 법적 절차에 활용할 수 있도록 하는 인식변화의 필요성과 장애아동의 법적 접근성을 강화시키기 위한 실질적인 조치들을 제안하였다.

Through looking at the case study of sexual assault on disability child from the angle of human rights, this study aims to present a policy improvement for protecting human rights of disabled children. For subjects, cases from first trial to third trial were chosen with the reflection of secured civil liberties, equal rights and social rights, which are basic contents of human rights, while applying principles of CRPD for analysis. As a result, at 1st and 2nd trial equality rights were not secured since ruling was reached not reflecting the characteristics of disabled children, civil liberties was posited without considering social rights. They were against the laws of CRPD especially without reflecting equality before law and principle of judicial access. On the other hand, the supreme court secured equality right, social right and civil liberties well reflecting the characteristics of disabled children and especially principles of CRPD. Based on the results of this research, this study proposed the need for changes of perception in judicial officers to prepare them for legal process by applying the viewpoint of human rights and practical steps to strengthen the legal access of disabled children.
