아동학대와 노인학대 관련법 법적 비교

A Study on Legal Comparison of Child Abuse and Elder Abuse

본 연구는 학대를 예방하고 학대받은 사람에게 적절한 서비스를 제공하기 위하여 법을 어떻게 개정해야 하는지에 목적을 두고 있다. 이에 주로 아동학대처벌과 노인복지법의 내용을 비교하였다. 연구결과는 다음과 같다. 첫째, 노인학대행위를 규율하기 위하여 노인복지법과는 별도록 노인학대처벌법제정할 필요가 있다. 노인인구가 증가되고 사회서비스가 지속적으로 증가하고 있는 상황에서, 노인학대를 노인복지법에서 규율하기에는 충분하지 못하다. 이에 특별법으로서 노인학대처벌법의 제정이 요구된다. 둘째, 노인이 학대를 받아 응급한 상황에 이를 경우 아동학대처벌법 제12조 피해아동에 대한 응급조치처럼 법조문을 좀 더 구체적으로 개정할 필요가 있다. 셋째, 신고의무에 대한 내용도 현재의 실정법에 맞게 개정할 필요가 있다. 넷째, 재원과 관련된 내용이다. 재원은 학대예방과 감소에 영향을 미치는 주요인이다. 이에 재원관련 법조문을 비교하면, 여러 가지 제도에 소요되는 비용에 있어서 신고의무교육, 의료기관 치료비 등 좀 더 구체적인 비용이 법조문으로 구성될 필요가 있는 것으로 나타났다.

This study aims at how the law should be amended to prevent abuse and provide appropriate services to people who are abused. In this regard, the contents of the Act on the Punishment of Child Abuse Crime and the Welfare of the Elderly were compared. The results of the study are as follows. First, The Act on the Punishment of the Elderly Abuse Crime needs to be enacted to regulate the prevent of abuse separately the Welfare of the Elderly. With the elderly population increasing and social services steadily increasing, it is not enough to regulate the abuse of the elderly under the Welfare Act. As a special act, the Act on the Punishment of the Elderly Abuse is required. Secondly, It is a need to revise the Welfare of the Elderly law, as the Article 12 of the Punishment of Child Abuse Crime, in case an elderly is abused and comes to an emergency. Thirdly, the content of reporting obligations should also be revised in accordance with the current law. Forthly, it is related to economic resources. Economic resources are the major contributors to the prevention and reduction of abuse. More specific costs for education of reporting obligation and medical expenses should be revised into legal legislations.
