사립대학 폐교에 관련된 입법과제 분석

Legislative Tasks for the Closure of Private Universities

본 연구는 사립대학의 원활한 폐교를 지원하고 폐교대학 구성원들의 사회안전망 구축에 요구되는 입법과제를 탐구하고 있다. 18대 국회부터 20대 국회에 이르기까지 발의되었던 법안의 내용을 분석하고 이해관계자 면담을 통해서 입법과제를 도출하였다. 11개 법안이 발의되었으나 재산출연자에게 잔여재산 환원여부 대한 이견으로 입법이 이루어지지 못했다. 잔여재산을 해산법인에서 지정하는 자에게 돌려주어서 자발적인 폐교를 유도하자는 주장과 사립대학의 공공성을 들어 부정하는 주장이 팽팽하게 대립하고 있다. 본 연구는 사립대학 폐교에 따른 구성원 피해를 최소화하고 자발적 구조조정을 촉진하는 입법과제를 제시한다. 첫째, 대학 강제 폐쇄 명령 전에 정부는 학생‧교직원 보호와 교육재산 처리 방안을 마련한다. 둘째, 폐교대학 지원 기금조성과 관리지원 센터의 설립이다. 셋째, 잔여재산은 설립자 또는 정관이 지정하는 자에게 환원토록 하고, 대학운영 위기에 처한 한계대학의 자진 폐교를 유도하는 차원에서 증여세 감면 등 유인책을 제안하고 있다.

This study explores the legislative tasks required for promoting voluntary restructure of marginal private colleges and securing the social safety of professors and staffs of the closed private colleges. Analyzing the contents of the legislation that has been initiated from the 18th National Assembly to the 20th National Assembly, and solving research problems through interviews with stakeholders. Eleven legislative initiatives have been submitted, but legislation has not been achieved by dissent among parliamentarians on the belonging of the residual property. One contend that the residual property shall be returned to the school juristic persons. Another contend that residual property shall be revert to national treasury. This study suggests three legislative tasks that minimize the damage caused by the closure of private universities and promote voluntary restructuring. First, it is necessary to protect students, professors & staff, and educational property before the college forced shutdown order. Second, the establishment of a closed university support fund and the establishment of a closed school management support center. Third, the residual property shall be attributed to the juristic person or the person designated by the articles of incorporation. Moreover, it is worth considering incentives such as the reduction of the gift tax in order to induce the closure of the marginal universities in the crisis of university operation.
