조선창업 시 三峯은 국가의 규모와 운영방식을 중국 고대의 다양한 시각을 조화롭게 엮어󰡔朝鮮經國典󰡕을 통하여 제시하고, 조선시대 근본 국가통치 철학과 제도인 󰡔經國大典󰡕구조 차원의 통치내용과 방법 등에 영향을 미쳤다. 󰡔朝鮮經國典󰡕의 구조가 중국의 󰡔周禮󰡕 등과 차별적인 점은 무엇보다도 민본을 중시하고 있다는 점과 王의 규정과 재상론(三政丞)등으로 이는 성리학을 주로 하면서도 사공학 등을 融合 창조적으로 반영하여 조선에 적용시켰다는 점이다. 이 글은 조선시대 삼봉의 민본사상의 조명을 통하여 민본사상의 근원과 원류, 현시대의 적용방안과 효과 등을 모색한다. 특히 새로운 사상을 󰡔朝鮮經國典󰡕에 담은 삼봉 정도전의 헌법사상을 재조명하여 국가제도를 정초한 지혜와 시사점을 재조명하여 혼란한 사회를 재구조화 시킬 수 있는 사회변화 대응과 개헌의 초점과 시사점을 백성의 민본사상 측면의 국민기본권, 복지권, 언론권, 지방자치, 시민권 등과 관료제 측면의 상호견제와 균형을, 군주 측면의 仁政과 王道 사상 등에 초점을 두고, 삼봉의 개혁정신과 사상적 내용을 발굴하여 국정의 제도적 시사점과 활용방안으로 구분하여 제언하였다.
The article is organized as follows. The first clarifies research questions, the purpose of study and methodology about legal minds of Sambong Chosunkyunggukjeon in Chosun dynasty. The second deals with methods of study, literature review, previous research and theoretical background of research on legal minds of Sambong Chosunkyunggukjeon in Chosun dynasty. The analytical variables of a characteristic of legal thoughts of Sambong in Chosun dynasty are people, bureaucracy & monach, so forth. The third section presents analysis variables about case studies of legal minds of Sambong Chosunkyunggukjeon in Chosun dynasty. For example, those are Kwajon law(Gua Jun Baeb), so forth. The forth section suggests research effect & limitations of effect analysis of legal minds of Sambong Chosunkyunggukjeon in Chosun dynasty. The last section concluded. There were some suggestion & expectation effect of the legal minds of Sambong Chosunkyunggukjeon in Chosun dynasty & suggested research effect & limitations of effect analysis of their subjects in the early era of the Chosun dynasty.
