부동산중개사 자격증 취득을 위한 교육내용 및 부동산중개 과정 국제비교를 통한 시사점 연구

Comparisons of the Education Contents for Achieving the License Real Estate Agents License and the Current Practices Among the Countries

본 연구의 목적은 미국과 우리나라의 부동산중개 제도를 비교분석하여 부동산중개인의 전문성을 향상시키고 역할을 강화하는 방안을 찾아보는데 있다. 연구의 목적을 달성하기 위하여 부동산중개인 제도를 비교하기 위하여 한국과 미국(캘리포니아주)의 부동산중개인 관련법과 제도를 문헌분석을 진행하였다. 캘리포니아주의 부동산법(Real Estate Law)을 연구대상으로 선정한 이유는 1917년 제정된 미국 최초의 부동산법으로, 역사가 오래되고 내용이 구체적이어서 다른 많은 주에서 유사한 법률 제정의 모델로 사용되고 있기 때문이다. 켈리포니아 주의 중개인 자격의 취득이나 중개업 종사의 요건, 중개인의 역할 등에 대해 양국의 법률 규정을 살펴본 결과, 중개인들의 전문성과 업무능력을 강화하기 위한 규제들을 미국이 더 엄격하게 두고 있음을 알 수 있었다. 이는 한국의 중개시장에서 자주 지적되던 중개인의 전문성과 역할에 대한 문제를 제도적 보완을 통해서 완화시킬 수 있음을 시사한다. 즉, 한국도 공인중개사 자격증을 취득하기 위해서는 대학수준의 필수 교육과정을 이수하도록 하는 방안, 실무경력을 일정시간 갖춰야 중개사무소 운영을 가능토록 하는 방안, 자격증의 갱신 제도 도입 및 재교육 강화 등을 적극적으로 검토･도입함으로써 중개인의 역량을 높이기 위한 제도적 장치를 마련해야 한다는 것이다.

The purpose of this study is to find the problems associated with real estate brokerage. For this purpose, the ways to enhance the professionalism and role of real estate agents were explored by comparing the real estate brokerage system in the United States and Korea. In the case of United States, the California state was chosen because it is the first state that real estate law enacted and has been a role model for other stated. The acquisition of the broker s qualification, the requirements of the broker s occupation, and the role of the broker were focused. According to the data analysis, the United States apply more strict rules to achieving the real estate brokerage license and business practices to enhance the expertise and performance of the brokers. The US regulations require the high quality of professionalism and expertise in the field and emphasize the responsibilities and roles of brokers than the case of Korea. Based on the research results, it is suggested that Korea also needs to require college level curriculum to achieve the license in order to enhance the performance of brokers and professionalism in the field.
