Necessity and Direction of Implementing Local Community Police System According to Decentralization Idea

자치경찰제도의 도입 목적은 지역치안행정서비스를 통한 주민밀착형 치안서비스제공과 지방분권이념의 구현이라 할 수 있다. 대한민국 헌법에서도 지방자치제도가 헌법적 가치에 근거한 것임을 명확히 하고 있는데, 이러한 지방자치제도의 완성을 위해서는 자치경찰제도 도입이 필수적이며, 이는 권력기관 개혁의 시대적 흐름임과 동시에 국민적 요구이기도 하다. 또한 치안행정에 있어서도 날로 범죄는 지능화되고 흉악해짐에 따라 신종 진화 범죄에 대응하기 위해 치안 R&D 활성화, 과학수사 역량을 확대하고 있다. 자치경찰제도의 도입은 지방자치제도와 함께 시행되어야 함에도 불구하고 경찰은 정부가 바뀔 때마다 여러 유형의 자치경찰 모형을 검토해 왔으나, 지방자치단체의 재정여건과 정치적 상황에 따른 어려움으로 인하여 도입되지 못하였다. 문재인 정부는 국정운영 5개년 계획의 100대 과제의 하나로 ‘광역단위 자치경찰제 도입‘과 함께 2017년부터 자치경찰 관련 법률을 제·개정하고 2018년 시범 실시를 거쳐 2019년 전면 실시함을 천명함으로써 이에 따른 경찰청 경찰개혁위원회에서 광역단위를 전제로 하는 자치경찰제 권고안을 발표하였고, 광역지방자치단체의 하나인 서울시에서도 역시 광역 단위를 전제로 하는 자치경찰제 도입 모델(안)을 제시하였다. 따라서 이 논문에서 일찍이 시행되고 있는 제주자치경찰의 운영성과를 토대로 경찰개혁위원회에서 논의된 자치경찰제 도입 필요성과 방향을 제시하여 보고. 자치경찰제가 성공하기 위해서 몇 가지 방향과 틀을 마련함으로써 향후 광역단위 자치경찰의 성공방향에 대해 살펴보고 정책적 제언을 제시하고자 한다.

The goal of implementing local community police system is to provide security service closely linked with residents and to realize decentralization idea via local security administration service. In the constitution of the Republic of Korea, it is clarified that the municipal system is based on constitutional values. For competition of such municipal system, implementation of local community police system is mandatory, and this is also trend of renovating authority and national demands. Also in security administration, crimes are becoming more intellectualized and brutal day by day. Accordingly, police is activating R&D and expanding scientific investigation capacity to respond to newly evolving crimes. Despite local community police system should be enforced with municipal system, the police studied various types of local community police model, but local community police system has not been implemented due to difficulties resulting from financial status and political conditions of local governments. Moon Administration listed “Implementation of local community police system in metropolitan areas” as its one of 100 five-year plans, and from 2017, it amended laws regarding local police system, implemented it as demonstration in 2018, and announced full-scale implementation in 2019. Accordingly, the Police Renovation Committee of National Police Agency announced proposal of recommendation for local community police system on the premise of metropolitan implementation, and Seoul City, one of the local governments, suggested a model of local community police system on the premise of metropolitan implementation as well. Therefore, this thesis suggests the necessity and direction of implementing local community police system discussed in the Police Renovation Committee based on the accomplishment of Jeju local police already under operation. It also suggests several directions and frames for success of local community police system to go over the success direction of metropolitan local police and offer policy proposals in the future.
