‘국가교육위원회’법률안에 대한 비판적 검토

Critical Study on Legislative Proposal of National Education Commission(NEC)

본 연구는 국회에 상정된 ‘국가교육위원회 설치 법률안’의 정합성을 검증하고 있다. 국가교육위원회 설치 목적 실현의 한계점, 기구 신설 성과의 불확실성과 부작용을 논의함으로써 국가교육위원회 신설에 대한 비판적인 견해를 논구한다. 국가교육위원회 설치는 한국 정치 현실에서 실효성이 떨어지고, 정부조직 개편 원리에도 부합되지 않는다. 첫째, 초정권적인 교육정책 형성은 민주주의 책임정치 원리에 어긋나고 실현가능성 낮아 기구 신설의 목적 달성이 불투명하다. 둘째, 교육부 업무와 중복되지 않는 독자적 사무가 적고 정부조직개편 원리에 부합되지 않아 국가교육위원회 신설은 행정 비효율을 초래할 것이다. 셋째, 교육관료의 교육정책 독점해소와 사회적 합의를 통한 교육정책은 기구설치보다는 분권․자율화와 국회의 입법을 통해서 실현할 수 있다. 국가교육행정조직의 능률성 제고와 교육정책추진의 효과성 증진보다는 조직개편을 진보나 개혁과 동일시하는 상징적·정치적 목적에서 논의되고 있기 때문에 법안에서 제시한 국가교육위원회 설치 제안논리는 타당성과 실천가능성이 낮다. 따라서 국가교육위원회 설치보다는 교육기본법에 교육제도의 안정성 원칙을 규정할 것을 본 연구는 제안한다.

This study criticizes the validity of the National Education Commission s bill proposed by National Assembly members. This article discusses the limitations of realizing the purpose of establishing the NEC and the uncertainties and side effects of the establishment of the organization. The establishment of the NEC is ineffective in the reality of Korean politics and does not conform to the principles of government reorganization. First, To request incumbent government to accept the former government s policy is contrary to the democratic responsible political principle, and it is not feasible and it is unclear to achieve the enforcement. Second, since there are few independent affairs that do not overlap with the Ministry of Education s work and it does not meet the principle of government organization, the establishment of the NEC will cause administrative inefficiency. Third, Educational policy monopoly of educational bureaucracy and social consensus can be solved through decentralization and autonomy and legislative process of the National Assembly. The study suggests that legislative proposal would be submitted based on the symbolic and political purpose of identifying the organizational reorganization rather than improving the efficiency of national education administrative system and promoting educational policy quality. In this article, two legislative tasks are proposed instead of the establishment of the NEC in order to stabilize education policy in long term.
