장애인 인권관련 국내규범의 실효성 확보방안 연구

본 연구는 헌법에 보장된 기본권이 장애인에게도 적용될 수 있도록 인권관련 규범들의 분석을 통해 장애인 인권의 실효성 확보방안을 고찰하고자 하였다. 장애인 인권의 문제를 법제적으로 탐구하기 위해 인권관련 국내규범들과 헌법에 명시된 관련조항들을 문헌조사하였다. 인권의 실효성 확보방안 모색을 위해서 헌법의 이념에 기초하여 장애인의 인권과 기본권을 고찰하였다. 또한 장애인 관련법 중에서 인권보장규범으로서의 기본법인 장애인차별금지법에 대해고찰하였다. 또한 지역사회차원에서의 장애인 인권실천 문제 논의를 위해 지방자치단체의 인권조례 제정 상황을 분석하고 이행과제를 모색하였다. 연구결과는 먼저 기본권관련 규범 정비로 헌법에서의 차별금지 명문화와 자치법규의 정비 등이 제시되었다. 둘째. 장애인차별금지법의 제도 개선으로 장차법의 국내법적 체계성 확립, 인권중심의 장애개념 설정, 정당한 편의제공의 실현, 권리구제의 규범성 강화 등이 제시되었다. 셋째, 인권조례 수용 및 권고 이행방안으로 지방자치단체의 인권기본조례 이행, 장애인 인권보호를 위한 지방자치단체 이행 과제 등이 제시되었다

The purpose of this study is to examine the effectiveness of the human rights of persons with disabilities by analyzing human rights norms so that basic rights guaranteed by the Constitution can be applied to persons with disabilities. The research method is literature survey on the domestic norms related to human rights and related articles specified in the Constitution. First, we examined the human rights and fundamental rights of persons with disabilities based on the ideology of the Constitution in order to find ways to secure the effectiveness of norms on human rights of persons with disabilities. Also it was discussed about The Anti - Discrimination Act for persons with disabilities as a disability rights law guarantees norms of the Basic Law. In addition, we analyzed the human rights situation of the local government ordinance and evaluating the implementation of projects seeking effective ways. The results of the study are as follows. First of all, the regulation on the basic rights has been proposed to prohibit discrimination in the Constitution and to improve the self-governing law. Second. The improvement of the system of The Anti - Discrimination Act for persons with disabilities has been suggested to establish the domestic legal system, to establish the concept of disability based on human rights, to realize the provision of legitimate convenience, to strengthening norms of right relief. Third, human rights ordinance acceptance and recommendation implementation plan was suggested implementation of human rights fundamental ordinance of local governments, Implementation task of local autonomy for the protection of human rights of the disabled.
