사회복지 수급권자의 절차적 권리 실현에 관한 법제 개선방안 연구

A Study on the Improvement of Legislation on the Implementation of Procedural Rights of Social Welfare Recipients

사회복지 수급권자의 실체적 권리는 절차적 권리의 뒷받침을 통해 비로소 실현될 수 있다. 그러나 사회복지 사업에 대한 신청 과정에서 수급권자는 자신의 권리를 실현하기 위한 시작점에서부터 갖가지 구비서류의 제출을 요청받고 복잡한 규정에 부딪치며 여러 번의 시행착오를 경험하게 되는 것이 현실이다. 본 연구에서는 수급권자가 사회복지 급여를 신청하면서 경험하게 되는 프로세스들을 중심으로, 어떤 절차적 어려움을 겪고 있으며 그 주된 요인들이 무엇인지에 대한 분석을 통하여 사회복지 수급권자의 권리 실현과 관련한 법제의 개선방안들을 모색하여 보았다. 첫 번째로는 급여 신청 시 오프라인과 온라인의 방법을 택할 경우로 나누어서 수급권자가 가장 먼저 대면하게 되는 신청 단계에서 지자체에서 이루어지는 절차의 특징이 무엇인지, 이와 관련한 실무의 경향은 어떠한지, 이들 과정에서 어떤 어려움을 경험하고 있는지 분석해 보았으며, 그 중에서도 특히 구비서류와 관련한 문제점들에 주목하였다. 또한 온라인 신청에서의 높은 반려율 등에 대한 검토를 통해 신청인과 담당자에게 가중된 절차적 부담을 완화할 근본적인 개입이 필요하다는 점을 살펴보았다. 그리고 국민들의 권리 실현 절차를 간소화해 온 타 기관 혁신 사례를 분석해 보고 사회복지 수급권자의 절차적 권리 실현을 위하여 참고할 수 있을 만한 중요한 개선 방향들에 관하여 시사점을 도출하였다. 다음으로는 앞서 살펴본 내용과 관련된 수급권자의 권리 실현 관련 법제의 현황을 살펴보았다. 이와 같은 검토 내용을 토대로, 행정정보공동이용을 통한 연계의 강화를 비롯한 시스템적 개선이 법제에 담기기 위한 개선방안을 제시하였다. 본 연구를 기반으로 하여 사회복지 수급권자의 절차적 권리가 더욱 잘 보호되기 위한 실천 과정들이 향후 계속해서 이어지리라 전망한다.

Substantive rights of recipients of social welfare can only be realized through the support of procedural rights. However, in the process of applying for social welfare projects, the beneficiary is asked to submit various documents required from the beginning to realize his or her rights, and undergoes several trials and errors in the face of complex regulations. This study focuses on the processes experienced by beneficiaries in applying for social welfare benefits, and analyzes what procedural difficulties they face and what the main factors are. First, we divided it into offline and online methods for applying for benefits and analyzed the characteristics of the procedures performed by the local governments at the application stage where the beneficiaries first face, the trends in practice, and the difficulties they experienced in these processes, among other things, and particularly noted the problems associated with the required documents. In addition, the review of high rates of return in online applications found the need for fundamental intervention to ease the increased procedural burden on applicants and staff. Besides, by analyzing other institutions innovation cases that have simplified the people s rights realization procedures, we drew suggestions on the major improvement that could be considered for realizing the social welfare beneficiaries procedural rights. Next, we looked at the current status of legislation with regard to the realization of the rights of beneficiaries related to the foregoing discussion. On the basis of these reviews, this study proposed the improvement measures for the improvement of the system, including the enhancement of links through the use of public information sharing. Based on this study, it is expected that practice will continue in the future to better protect the rights of social welfare recipients.
