Analysis of Recent Legislative Trend and Implications on the Anti-corruption Using Open Data in Healthcare Sector - With Special Attention to Opening up and Analysis of Payment Data and Claim Data in USA

보건의료분야는 방대한 양의 공공데이터가 생성·수집되고 있으며 비교적 부패위험이 높은 분야로서 주요국은 보건의료 공공데이터의 개방 및 분석 활용을 통해 부패를 방지하기 위해 노력하고 있다. 특히 미국은 데이터의 개방 및 활용을 통해 보건의료분야의 부패를 방지하고 있는 대표적인 국가에 해당한다. 본 연구는 보건의료분야 부패의 개념 및 새로운 부패방지수단으로서의 공공데이터의 활용을 검토하고, 미국의 공공데이터를 활용한 보건의료 부패방지 법제동향을 분석하였다. 미국의 공공데이터를 활용한 보건의료 부패방지 법제동향은 지불데이터 및 청구데이터의 개방 분석활용을 중심으로 분석하였다. 미국의 동향에 대한 검토를 바탕으로, 본 연구는 공공데이터를 활용한 보건의료분야 부패방지를 위한 개선점을 제시하였다. 본 연구를 기반으로 하여 보건의료 및 복지 재정 데이터 개방 및 분석 활용 시스템 구축과 고도화를 위한 입법적 논의가 계속해서 이어지기를 희망한다.

A huge amount of open data is generated and collected in the healthcare sector and the healthcare sector has a relatively high risk of corruption. Major countries are striving against corruption through opening up and analysis of open data in healthcare sector. The United States, in particular, is a representative country that prevents corruption through the opening up and analysis of open data in healthcare sector. This study is to examine recent legislative trend on the anti-corruption using open data in healthcare sector, while reviewing the concept of anti-corruption in healthcare sector and utilization of open data as a new tool for anti-corruption. For this study, we analyzed legislative trend on the anti-corruption with special attention to opening up and analysis of payment data and claim data in USA. On the basis of these reviews, this study proposed the improvement measures for anti-corruption using open data in healthcare sector. Based on this study, it is expected that discussions will be continued in the future for the opening up of financial data and the construction and improvement of data analysis systems in healthcare and welfare sector.
