자유주의 우생학은 자유주의적인가?*59)

Is Liberal Eugenics Liberal?

본 논문의 목적은 자유주의 우생학의 이론적 토대와 정당화 논거에 대한 분석을 바탕으로 자유주의 우생학의 내재적 한계를 비판적으로 고찰하는 것이다. 즉, 본 논문은 자유주의 우생학이 과거 권위주의적 우생학과 달리 개인의 자율성 존중, 해악 금지의 원칙 준수, 국가 중립성 유지라는 세 가지 전제를 모두 동시에 충족함으로써 ‘자유주의적’이라는 평가를 받을 수 있는지를 검토하고자 한다. 첫째, 자유주의 우생학은 우생학적 조치의 결정자와 그 대상자가 일치하지 않기 때문에 자녀의 자율성을 침해하거나 제한하는 결과를 초래할 수 있고, 자녀의 추정 동의를 확보할 가능성이 높지 않기 때문에 온정적 간섭주의를 통해서도 정당화되기 어려울 것이다. 둘째, 향상 기술의 혜택이 모든 계층에게 고르게 분배되는 것이 아니라 특정 계층에게 집중될 가능성이 높기 때문에, 자유주의 우생학은 현존하는 사회적 불평등과 사회 계층의 양극화를 심화시킬 수 있고, 이러한 정의 문제는 국가의 공적 보조를 통해서도 해결하기 어렵기 때문에 사회적 약자에게 실질적으로 해를 끼치는 결과를 야기할 수 있다. 셋째, 자유주의 우생학이 향상에 의해 발생하는 사회적 불평등의 규모를 완화하기 위해 국가 개입의 필요성을 인정한다면, 이는 좋은 삶의 문제와 가치의 우선성 논쟁과 관계된 국가 중립성 논쟁을 불러일으킬 수 있다. 요컨대, 자유주의 우생학이 그 세 가지 전제를 모두 동시에 충족하는 것은 어렵기 때문에, “자유주의 우생학은 자유주의적인가?”라는 질문에 긍정의 답을 얻기도 어려울 것이다.

The purpose of this paper is to suggest a internal critique of liberal eugenics by analyzing its theoretical foundations and justifying reasons. In other words, I try to examine whether liberal eugenics, unlike authoritative eugenics, can be liberal by meeting all three premises: individual autonomy, no-harm principle, and state neutrality. (1) Parents’ free choice of eugenic enhancement infringes their children’s autonomy because there is a asymmetry between the chooser of eugenic enhancement and its object. Liberal eugenics can’t be justified by paternalism because parents can’t obtain the hypothetical consent from their children. (2) Liberal eugenics worsens the social inequality and the polarization of social classes because enhancement technologies benefit a certain social class. Since these problems are difficult to solve by public assistance programs, liberal eugenics actually results in harming the socially disadvantaged. (3) If liberal eugenics advocates acknowledge state intervention to solve these problems, it leads to a debate on state neutrality, which is also related to a debate on the priority among values and the conception of good life. In brief, we could not give a positive answer to the question “Is liberal eugenics liberal?”, because it is difficult to meet all three premises of liberal eugenics simultaneously.
