법관의 역할과 역량 분석

A Study on Judge`s Roles and Competencies by Delphi Method and IPA

본 연구는 현직 법관들이 인식하고 있는 자신의 역할과 역량에는 어떤 것이 있는지, 역할과 역량에 대한 인식의 차이 및 상대적인 우선순위에 대해 알아보고자 하였다. 이를 위해 본 연구는 총 19명의 현직 법관이 참여하는 델파이 조사 방법과 델파이 자료를 이용한 IPA를 수행하였다. 연구결과는 다음과 같다. 델파이 조사를 통해서는 첫째, 판단자, 분쟁해결자, 규범해석자, 사회정의실현자, 절차진행자, 재판서작성자라는 6개 중요 역할이 도출되었다. 둘째, Spencer와 Spencer(1993)의 역량모형에 따른 지식, 기술, 가치와 태도, 자기관리의 4개 주요 역량영역에서 총 29개의 하위역량들이 확인되었다. 셋째, 델파이 조사에서 확인된 서로 상이한 역할과 역량은 IPA의 4개 좌표(계속유지, 과잉, 저순위, 집중영역)에 속하였다. 본 연구의 결과는 현직 법관들이 자신의 여러 역할을 인식하고 있다는 점, 그 역할은 각각 상이한 하위역량들을 요구한다는 점을 시사하고 있다. 이상의 연구결과를 토대로 신임법관의 교육훈련에 대한 시사점 및 관련 후속연구가 제안되었다.

The purposes of this study were to investigate judge`s roles and competencies, and to analyze the differences of awareness and relative priority on the roles and competencies. For these purposes, the study conducted delphi method and IPA(Importance-Performance Analysis). Expert panels participated in the delphi and IPA were 19 incumbent judges who worked for the judicature. The result of the study were as follows. By the delphi method, (1) there were six important roles identified including judgment, dispute settlement, norm interpretation, realization of social justice, proceedings progress, and writing court records; (2) there were twenty-nine sub-competencies identified regarding judge`s varied roles that were included in the four main competency domains(knowledge, skill, value & attitude, & self-management) from the Spencer & Spencer(1993) model of competency. By the IPA, (3) the different roles and sub-competencies identified in the delphi method belonged to one of the four IPA coordinates(keep up good work, possible overkill, low priority, and concentrate here). The study results indicate that incumbent judges recognize their varied roles and the roles require many different sub-competencies respectively. Based on the results, several implications and recommendations were made for the better education-training for newly appointed judges and for future research.
