병원학교의 법적 위상과 관련 법 조항 개선방안

Discussions on the Law Improvement for Expand of Administrative and Financial Support for Hospital Schools

본 연구는 병원학교의 인력 배치 및 시설·설비 기준과 행·재정적 지원의 법적 근거 마련을 위해 관련 법률 조항의 검토를 바탕으로 개선방안을 논의하였다. 현행법상 병원학교는 특수교육기관이나 순회교육으로서의 위상이 확보되어 있지 않다. 이로 인해 병원학교 운영에 필요한 인력, 시설·설비, 예산 지원의 기준과 법적 근거가 부족한 실정이다. 이를 개선하기 위한 관련법 조항의 개선방안은 다음 중 택일하거나 병행할 수 있다. 첫째, 병원학교를 「장애인 등에 대한 특수교육법」제6조에 따른 ‘특수교육기관’의 한 유형으로 포함한다. 둘째, 병원학교를 「장애인 등에 대한 특수교육법」제25조에 따른 ‘순회교육’ 기관의 한 유형으로 포함한다. 셋째, 병원학교를 기존의 순회교육 기관이나 특수교육기관과는 다른 한 유형으로 간주한다. 이 경우 「장애인 등에 대한 특수교육법」에 병원학교 설치 및 운영에 관한 별도의 조항을 신설한다. 이는 다른 관련 법률 및 조항 개정의 수반이 요구되기 때문에 이에 관한 논의도 필요하다. 향후 병원학교 관련 조항을 수정·보완할 경우 공통적으로 특수교사 및 관련 서비스 인력 배치 기준, 시설·설비 기준, 행·재정적 지원의 책무 등의 내용이 포함되어야 한다. 이외에도 학적 및 출결, 교육과정 운영, 치료비 지원 등에 관한 내용도 논의를 고려할 수 있다.

This study discussed on law improvement for expand of administrative and financial support to hospital schools. According to current law, hospital schools do not belong to special education institutions or itinerant education. As a result, there was a lack of standards and legal basis for personnel, facilities, equipment, and budget for hospital school operations. To solve this problem, it is necessary to choose one of the following or do more than one parallel processing. First, add provisions of hospital schools in provisions of Itinerant education. Second, hospital schools be included as a category of special education institution, or establish the special schools for health impairments. Third, newly establish the provision of hospital school establishment and operation. These improvements suggestion have been discussed on required to be accompanied by amendments to other relevant provisions. In addition, it was discussed that the revision and supplement of the provisions related to the hospital school should include contents such as standards for placement of special education teachers and related service personnel, standard for facilities and equipment. And discussions can be considered on the management of attendance, operation of curriculum, and support for medical expenses.
