체육인재 육성사업 발전을 위한 법령 개정방안

A Legal Study on Improvement Plans for the Sports Talent Fostering Project Development

이 연구는 체육인재 육성사업의 지속적인 발전을 위해 도움을 줄 수 있도록 관련 법령 검토를 통하여 개선방안을 제시하는데 있다. 국가대표 엘리트 선수 중심의 소수 체육인 지원에서 벗어나 스포츠 선진 국가에서처럼 법령에 근거하여 다수 체육인의 다양한 진로기회 및 취업지원을 위한 스포츠 정책 전환이 시급하다. 현재 체육인재 육성사업의 추진근거는 국민체육진흥공단 ‘정관’에만 반영되고 있고 「국민체육진흥법」에는 명확한 근거를 찾아보기 어렵다. 이에 따라 체육인재 육성사업의 법령 개정을 위해 체육인재 양성과 관련하여 「국민체육진흥법」, 「스포츠산업 진흥법」, 「체육시설의 이용 및 설치에 관한 법률」 등을 검토‧분석하였고, 다음과 같은 결과를 도출하였다. 첫째, 「국민체육진흥법」에 국민체육진흥공단의 체육인재 육성사업이 주요 업무로 명시되어야 한다. 둘째, 「국민체육진흥법」에 체육인재 정의 및 유형, 체육인재 육성 사업을 추진할 수 있는 체육인재 육성 연간 교육계획, 전문기관 지정 등이 신설되어야 한다. 셋째, 체육인재 육성사업의 효율적인 추진을 위해 국민체육진흥공단과 대한체육회 간 업무 구분과 역할 분담이 필요하다. 이 같은 체육인재 육성사업의 법령 개정을 통해 체육인의 경제적 자립기반 구축과 다양한 스포츠 분야에서 오랜 기간 체육인재로 활동함으로써 미래지향적인 스포츠 환경 조성에 기여할 것이다.

This study suggests improvement plans through review of relevant laws to help develop the sports talent fostering project. It is urgent to change sports policy from supporting a small number of national elite players to provide career opportunities and job support for a number of athletes based on laws, as in sports advanced countries. Currently, the basis for sports talent fostering program is reflected only in the articles of the Korea Sports Promotion Foundation, and it is difficult to find a clear basis in the National Sports Promotion Act. National Sports Promotion Act, Sports Industrial Promotion Act and the Act on the Establishment and Use of Sports Facilities related to the fostering of Sports Talent were reviewed and analyzed for the improvement of the National Sports Promotion Act. First, the National Sports Promotion Act should specify the sports talent fostering project of the Korea Sports Promotion Foundation as its main task. Second, the National Sports Promotion Act should include new clauses such as definition and type of sports talent, an annual plan for fostering sports talent and designation of specialized institutions etc. Third, the division of duties and roles between the Korea Sports Promotion Foundation(KSPO) and the KSOC(Korea Sports & Olympic Committee) in sports talent fostering project are necessary for the efficient operation. Through the improvement plans of laws for sports talent fostering project, it will contribute to the creation of a future-oriented sports environment by building an economic self-reliance base for athletes and nurturing sports talent active in various sports fields for a long time.
