미래지향적인 스포츠 환경조성을 위한 체육시설법 정비 방안

Propositions of the law related sports facility for construction of successful future-oriented sports environments.

본 연구는 미래 지향적인 스포츠 환경을 조성하는데 도움을 줄 수 있도록 체육시설 설치 및 운영에 관련된 법제도 검토를 통하여 체육시설 관련법의 개선방안을 제시하는 데에 그 목적이 있다. 본 연구에서는 체육시설 관련 정책으로 2030스포츠비전과 공공체육시설 균형배치계획을, 체육시설 관련법으로는 체육시설의 설치 이용에 관한 법률과 도시공원 및 녹지 등에 관한 법률을 검토하였다. 본 연구에서는 미래지향적인 스포츠 환경조성의 조건을 체육시설 설치 확대와 체육시설의 환경 제고로 정하고 이를 위한 체육시설법의 정비방안을 고찰한 결과는 다음과 같다. 첫째, 체육시설의 확대를 위한 방안으로는 체육시설 설치이용에 관한 법률의 생활체육시설의 설치기준을 강화하여 읍면동에도 실내체육시설을 설치할 수 있도록 설치기준을 개정하는 방안과 학교체육시설을 포함한 공공체육시설의 개방을 확대하기 위한 개정 방안 그리고 도시공원에 체육시설을 의무적으로 설치할 수 있도록 도시공원 및 녹지 등에 관한 법률을 개정하는 방안을 제시하였다. 둘째, 체육시설 환경 제고를 위하여 체육시설 내에 목욕시설을 설치할 수 있도록 하는 개정 방안, 자유 체육시설업 규정과 설치기준 마련을 위한 개정 방안, 단일종목간의 복합시설을 장려할 수 있도록 복합 체육시설업의 근거를 제공하는 방안을 제시하였다.

This research aimed to propose several improved plans of the law related sports facility through the review of the act as possibly helpful on development of sports environment of Korea. In details, the 2030 Sports Vision and the balanced disposition of public sports facility as the policies related on sports facility and the Physical Education Facility Act and Urban Parks and Green Areas Act as the laws related sports facility were reviewed. While the policies and laws were reviewed, extension of sports facility and improvement of sports environment are defined as the necessary condition for the construction of future-oriented sports environments in Korea. The research results were as follow; First, to extension of sports facility, a measure of tightening of Sports for All Facilities installation standards, a measure of widely opening of school sports facilities to public and a measure of revision of Urban Parks and Green Areas Act as the sports facilities could be installed in small cities to extend the sports facilities in Korea were proposed. Second, to improve the sports facility environments of Korea, a measure of bathing facility installation mandatory, a measure of preparation of installation standards for free sports facility and a measure of transformation of the complex sports facility on permission to sports facility on registration with revision of the Physical Education Facility Act were proposed in this paper.
