여행계약의 법적 성격에 관한 소고

On Legal Nature of Travel Contracts

여행이 늘면서 이로 인한 피해도 속출하고 있다. 한국소비자원에 따르면 2016년 ‘1372소비자상담센터’에 접수된 해외여행 관련 소비자 상담은 1만8457건으로 2010년(7295건) 대비 무려 153% 증가했다고 한다. 주요 피해내용으로는 계약해제, 일정 변경, 사고보상 미흡, 쇼핑 및 옵션 강요 등이 많았다고 한다. 이러한 경향에 보조를 맞추어 법무부에서는 민법의 개정을 통하여 민법전에 여행계약을 편입시켰다. 물론 과거에도 공정거래위원회의 표준약관에 의하여 어느 정도 규율되었지만 이른바 기획여행과 관련하여 여행자의 보호 내지 분쟁해결의 기준제시에는 부족함이 적지 않았기 때문이다. 이로써 여행자와 여행주최자의 권리·의무가 비교적 명확하게 되어 여행자를 보호하고 분쟁을 예방할 수 있게 되었다. 그러나 여행계약에 관한 조문은 8개에 지나지 않기 때문에 결국에는 그 법적 성질에 따라 민법의 일반이론이 적용되는 경우가 많을 것이다. 따라서 여행계약의 법적 성질을 고찰하는 것은 민법전의 여행계약에 관한 규정만으로는 규율할 수 없는 경우에 의의를 가진다고 할 것이다. 그래서 이 글에서는 여행계약의 법적 성질에 관하여 아직 민법전에 편입하지 못한 일본의 경우와 민법전에 편입시킨 독일의 경우를 택하여 학설과 판례를 통하여 이론적 동향을 고찰하고자 하며, 이어서 우리나라의 동향도 살핌으로써 법적 성질에 관한 비교가 가능하도록 하고자 한다(Ⅲ). 이에 앞서 여행계약의 의의와 우리 민법전에의 편입과정을 개관한다(Ⅱ).

With the increasing development of the social economy and the improvement of people s living quality, tourism has become an important way for people to relax themselves and enjoy their leisure time. Studying legal nature of the travel contracts, on one hand, can protect the travel consumers legitimate rights. On the other hand, it can promote the resolution of travel disputes and the healthy development of the whole tourism industry in the long run. This paper mainly studies on the legal nature of travel contracts in Korean Civil Code. In addition, the paper scrutinized Japanese tourism code and German Civil Code(BGB) for comparing their legal situations and ours. In reality, there are many disputes caused by the third party, such as restaurants, hotels, transportation companies etc. Breaking contract so that travel benefits are not in conformity with the contract. However, there are eight provisions on travel contract in Korean Civil Law. In many cases, we run short of proper provisions. On such an occasion, it is useful to apply the general principles and rules in Korean Civil Code. There were many reasons for clarifying the legal nature of travel contract.
