Major contents and issues of a bill ｢The act on the promotion and safety of leisure sports｣

해마다 행락철이 되면 많은 국민들이 레저스포츠를 만끽하며 즐기고 있다. 특히, 국민의 소득증가, 주5일 근무 정착 등으로 인한 여가시간 증가와 함께 단순한 스포츠 참여를 넘어 자연지형적 특성을 활용하여 모험과 성취욕을 느끼는 레저스포츠가 급속한 증가추세에 있다. 그러나 이와 같이 레저스포츠의 이용인구가 증가함에도 불하고 레저스포츠 시설설치에 대한 법적 근거 부재, 레저스포츠 시설 및 기구 등에 대한 안전관리 기준 미적용, 이용자 안전교육 등에 필요한 안전요원이 없거나 자격증이 없는 안전요원 채용으로 레저스포츠 사고가 빈번히 발생하고 있는 추세이다. 자연지리적 환경과 모험성을 바탕으로 하는 레저스포츠는 그 특성상 사고 시 사망 또는 심각한 중상을 초래한다는 것은 익히 알려져 있다. 특히 ATV로 잘 알려진 사륜오토바이의 경우 운전미숙이나 보호 장구 미착용으로, 번지점프는 번지코드(로프) 불량이나 착지 에어매트 협소, 패러글라이딩 및 초경량항공기는 기기조작 미숙이나 강풍 및 이상기류 조우 등으로 사망 또는 부상 등 안전사고가 매년 발생하고 있다. 또한, 국내에 정착된 레저스포츠는 자연지리적인 조건이나 설치장소에 따라 「항공법」, 「수상레저안전법」, 「건축법」 등 각기 다른 법률이 적용됨에 따라 레저스포츠의 통합적 발전 저해와 이용자 및 이를 통해 영업을 하는 업체들에 혼란과 불편을 초래하고 있는 실정이다. 이에, 늘어나는 레저스포츠 수요에 대비하고, 이용자들의 안전한 여가선용과 레저스포츠를 체계적으로 통합 관리･조정할 수 있는 법적 근거를 마련하고자 관련 법안을 2005년부터 발의하고 있으나 현재까지 입법되지 못하였다. 다음에서는 국회에 발의되어 계류 중인 「레저스포츠진흥 및 안전에 관한 법률안」의 제정 경과와 주요 내용을 살펴보고, 입법과정에서 제기되는 주요 쟁점을 분석하여 대안을 제시한다.

Every year, many people enjoy leisure sports in holiday seasons. In particular, leisure sports, inspiring achievement and adventure while utilizing topographic characteristics beyond mere participation, shows rapid growing trends together with an increase of leisure time due to income increment and the settlement of the five-day workweek. Although the number of leisure sports population increases, however, leisure sports safety accidents occurs frequently because there are lack of legal grounds on leisure sports facility installation, non-application of the safety management on leisure sports facility and apparatus, and absence of safety guards for safety education or recruitment of uncertified safety guards. Leisure sports are based on topographic characteristics and adventurousness. It is well known that the characteristics cause a death or serious injury when accident occurs. Safety accidents like death or serious injury occurs every year typically in the following areas: 1) a four-wheels motor cycle, also known as ATV(all-terrain vehicle), by poor driving or unfastened protective equipment, 2) a bungee jump by poor jumping-rope or a small-sized air mat for landing and 3) a paragliding or ultralight aircraft by poor operation, strong wind or turbulence. Further, leisure sports introduced in Korea are applied by the Aviation act, the Water-related leisure activities safety act or the Building act according to geographic conditions or places where facilities are installed. This hinders an integrated development of leisure sports and causes confusion and discomfort to users and business entities. Since 2006, related bill was proposed to prepare increasing demand on leisure sports and arrange a legal grounds to systematically manage and adjust users’ safe use of leisure and leisure sports, but has not been enacted yet. As in the following, we will examine the progress and major contents of 「The act on the promotion and the safety of leisure sports」, which is proposed and pending in the National Assembly of Korea. Finally we suggest alternatives based on the analysis of major issues brought up in the course of enactment.
