Research on the Problems of Injury Insurance for Professional Soccer Player in China

중국프로축구에 대한 자본 투입은 날로 증가의 추세를 보이고 있지만 프로선수의 권익과 관련한 상해보험제도는 크게 발전되지 못하였다. 중국에서 프로축구선수의 상해보험체계는 산재보험과 상업보험으로 구성한다. 그중에서도 산재보험이 주를 이루고 있으며, 입법이나 실무에서도 산재보험을 적하여, 기초적인 법적 보장을 제공하였다. 이와 동시 FC클럽에서도 일반 산재보험이 아니라 상업보험에 가입하여 프로선수를 위한 보충적인 보장을 제공한다. 보충보험에 가입하는 이유는 중국에서의 산재보험은 일반 근로자를 대상으로 설계 된 것이어서 프로축구선수에게 합리적인 보장을 제공하지 못한 상황이다. 예컨대, 산재보험은 근로자에게 기초적인 의료조치를 제공하는 것에 초점을 두어 절차가 번잡하여, 프로선수에게 효율적인 배상을 제공하지 못한다. 이 뿐만 아니라 약물 투여에도 도핑성분으로 인하여 제한을 받으며, 배상액의 한도 내에서 프로선수의 손해를 보상하지 못하는 등 문제점이 존재한다. 다음으로 산재보험이 충분한 보장을 제공하지 못한 이유는 프로선수의 질병예방 등 조치가 부족하기 때문이다. 산재보험제도는 산업영역의 근로자를 대상으로 상해위험을 예방하는 것이어서 프로선수의 질병 예방 조치가 충분하지 못하다. 산재보험에 존재하는 문제점에 대하여 입법자는 프로선수의 특성을 고려하여 프로선수의 상황에 적합한 산재보험조항을 설계하고 동종업계의 산재보험료를 인상하여, 프로선수를 위한 특수한 약품종목･상해감정기준과 절차의 제정을 통한 산재보험의 기초적 보장기능을 업그레이드하여야 한다. 그리고 중국 축구협회는 FC클럽의 상업보험 최저기준을 제시하고 이를 프로축구선수계약의 필수 조항으로 정하는 것을 통하여 선수의 이익을 보장할 수 있다. 이 밖에 중국 축구협회는 질병예방에 관한 제도적인 건설로 프로축구선수의 과학적인 운동을 이끌 수 있으며, 운동장 등의 기초시설의 표준화를 통하여 공정한 경기환경을 추진함으로써 선수의 상해발행을 예방할 수 있다.

The injury insurances for professional soccer player mainly consist of two parts, namely work-related injury insurance, the commercial insurance in the club and in the national team. However, there are some problems existing in this system. The compensation standards and the available treatment measures are limited in the work-related injury insurance system. As the special sport insurance is still immature in China, the supplement function of commercial insurance for player is not sufficient. The injury prevention measures of professional soccer player are lack of supervision, some infrastructures of the football field are not in good conditions, which would increase the possibility of injury. Therefore, the work-related injury insurance regulation should adopt some special measures for the professional soccer players according to the characteristics of injury, which including the special insurance rate, medical treatment and compensation standard. It is also necessary to promote the special commercial injury insurance for professional soccer player through the preferential policy and big data technology etc. Furthermore, the Chinese Football Association also should establish the injury prevention system for soccer player, which including the scientific sports instruction and the standardization of sports facility.
