팬픽션, 저작권 침해인가 공정이용인가?

사이버 공간을 삶의 중요한 무대로 인식하고 활동하는 N세대를 중심으로 팬픽션 문화가 확산되고 있다. 팬픽션은 저작권이 있는 원작에 의거하여 저작권자 허락 없이 자율적으로 창작되고 이용되어진다는 일반적 특성에 따라 원작 저작자의 저작권 특히 저작인격권으로서의 동일성유지권 및저작재산권으로서의 2차적저작물 작성권을 침해할 가능성이 높다. 실제 해외에서 팬픽션 관련 저작권 소송이 발생하고 있다. 이때 팬픽션이 보도 비평 교육 연구 등의 목적으로 이용되고 원저작물의 통상적인 이용 방법과 충돌하지 아니하고 저작자의 정당한 이익을 부당하게 해치지 않는다면공정이용으로 간주되어 저작권 침해 판정으로부터 벗어날 수 있다. 이에 본 연구는 국내외 저작권법 및 저작권 판례에 의거하여 팬픽션이 공정이용에 해당하는지혹은 저작권 침해에 해당하는지 분석해 보고 올바른 팬픽션 문화 확산을 위한 저작권 가이드라인을 제시하는데 그 의의를 둔다.

Fanfiction culure is being wide spread among N generation in Cyberspace. Fanfiction tends to infringe original author or copyright holder s copyright such as right to maintain integrity as a moral right and right to produce derivative works as a property right because it uses the original work without author’s permission. Meanwhile, in certain cases, fanfiction can be regarded as a fair use under the Copyright Act, that is not a violation of a copyright. However, as commercial or obscene uses are increasing, conflicts between original authors and fanfic writers are also increasing. Accordingly, purposes of this paper are to find the legality of fanfiction based on copyright laws and cases, and to suggest guidelines to fanfic creators and copyright holders of original works to settle and flourish subculture of fandom.
