스포츠는 기본적으로 남녀 종목이 구분돼 있다. 서로간의 신체적 기량 차이를 인정하기 때문이다. 그것은 스포츠가 정신운동이 아니라 육체운동이라는 사실에 기인한다고 할 수 있을 것이다. 최근 여자축구 박은선 선수의 성 정체성 논란이 불거졌다. 이는 우리나라 체육계의 고질적 비인간성을 극명하게 보여주고 있다 2013년 11월 5일 언론을 통해서였다. 엘리트스포츠의 구조적 문제점으로는 합숙구조, 성과주의, 남성적 문화 등에서 찾을 수 있겠다. 기본권의 범위는 날로 확장하고 있고, 스포츠권이 헌법상의 권리로 보장되어야만 하는 시점에 이르렀다. 헌법 제10조에 규정되어 있는 <인간의 존엄성 그리고 행복추구권>은 다양한 내용을 내포하고 있다. 그 안에는 스포츠권도 포함된다고 할 것이다. 특히 여성선수의 선수생활에 있어서의 각종 폭력은 이러한 헌법상의 행복추구권을 침해하는 중대한 예가 된다박은선선수사건의 경우 해결방안은 남성호르몬수치의 법정화에 있을 것이다. FIFA, IOC도 허용 범위와 수치 등을 정확하게 밝히지 못하고 원론적인 의견과 방침만 공표하고 있지만, 내부적으로 철학적, 의학적 가이드 라인은 분명히 있다. 박은선사건의 법적 문제는 직접적으로는 형법상 명예훼손, 민법상 불법행위에 의한 손해배상청구권 등이 있다. 본질적인 면에서는 국가의 기본권 보장의무, 행복추구권, 평등권, 교육기본권 등이 있을 것이다.

Because sports accepts difference between male and female, sports is basically divided into two parts, men s division and women s division. And this fact comse from characteristic of sports. This event shows chronic impersonality of Korea s world of sports. The problem of elite sports arise from camp training, outcome principle and male-dominated system. the range of fundamental human rights is extended more and more, and now sports right should be guranteed by the Constitution. Article 10 of the constitution, <the dignity of man and the right to pursue one s happiness> involves various meaning. And sports right is involved in that article too. Especially for female sports player, every kind of violation can be invasion of this article. For the case of Park, Eun-Sun, solution is legal definition of male hormone level. Both FIFA and IOC couldn t speak their mind about accurate value about this problem, but they might have philosophycal, medical guide line. there are many direct legal problem about this case. criminally defamation, civilly a claim for damages comes from illegality. in basic aspect, fundamental human rights, the right to pursue one s happiness, rights to equality, right to education are invaded.
